    3. Does anyone know if there were certain court records giving the mother custody in the case of illegitimate births? I am specifically talking about West Virginia, 1901. I am searching for the father who isn't listed in any of the census records. Pat

    3. Patricia, I don't know of anything giving custody to the mother of an illegitimate child, but hte courts often required a bastardy bond from the father guaranteeing support of the child. There is a book on Google Books called The Encyclopedic Digest of Virginia and West Virginia Reports, page 656  that explains it.
