I did a little more research (I can't help myself!) and found the following Tennessee statute relating to whether or not an offense is classified a misdemeanor or a felony: 39-14-105. Grading of theft. Theft of property or services is: (1) A Class A misdemeanor if the value of the property or services obtained is five hundred dollars ($500) or less; (2) A Class E felony if the value of the property or services obtained is more than five hundred dollars ($500) but less than one thousand dollars ($1,000); (3) A Class D felony if the value of the property or services obtained is one thousand dollars ($1,000) or more but less than ten thousand dollars ($10,000); (4) A Class C felony if the value of the property or services obtained is ten thousand dollars ($10,000) or more but less than sixty thousand dollars ($60,000); and (5) A Class B felony if the value of the property or services obtained is sixty thousand dollars ($60,000) or more. [Acts 1989, ch. 591, § 1.] Here's the punishment given in Tennessee for destroying a mailbox: 39-14-412. Mailbox tampering Damage or defacement of government property. (a) It is an offense for any person to knowingly damage, destroy, remove or otherwise tamper with a residential mailbox or other container such person knows or reasonably should know is used for the receipt or deposit of United States mail. Any person convicted of violating this subsection (a) shall be sentenced to not less than twenty-five (25) hours of public service work. (b) It is an offense for any person to knowingly damage or deface real or personal property of the state, or a subdivision thereof, by the painting or other permanent application of graffiti directly onto the property. (c) A violation of this section is a Class B misdemeanor. All violations shall be punished by at least twenty-five (25) hours of community service work to be determined by the court. I think it is a shame that 3 of the accused are female. Shows where our country is headed and what children are not being taught. Sounds like the usual "small town politics" that I work in every day. If you are kin to someone in office then the laws and rules don't apply to you. It will probably disappear off the records. Recently there was a shoot-out at a house 2 houses from my dad. The guy was drunk and he shot holes in the walls of his house shooting at his girlfriend who ran off. They called the SWAT team out and were crawling across my daddy's front yard on their belly - hiding behind trees to get a shot at him, etc. Then the District Attorney showed up and said the guy was the brother of the DA's best friend. He told the police to go home - that the guy would sleep it off and would go into the police station with his brother the next day. They left and didn't file any charges or do anything to him. He has been caught with drugs and selling drugs and everything time after time and has been in jail only once for a few hours until the DA came down and got him out. Laws don't apply to people who have friends in high places and records can disappear "accidentally". The following is only my opinion but is based my findings on what has transpired in this case; There was no cover up by the newspapers because there were no arrests and the newspapers have an arrest report they report each week. Citations were issued since it was a misdemeanor because of the $500 damage amount. It has not come out in the papers on the General Sessions Court report because the case has not been heard but will be next Wednesday. Following that the results will be published. There were 2 witnesses that were not mentioned in the Citations. Estimates have been made of $6000. damage yet only $500. was shown by the Sherriff’s investigator. It is unknown why or by whom that there are these differences. It would be a good question to pose to the authorities. Here is what is written on the citations by Inv. Marty Plunk the affiant of the Weakley County Sherriff’s Dept. “The defendant did go to the New Hope Methodist Church on Sandy Branch Rd. and did participate in the Vandalism of the church along with some mailboxes on Stella Ruth Rd. The defendant did give the Affiant a written statement.” These were each signed by the Affiant and the 5 adult Defendants. The Juvenile case will be in Juvenile court. Maybe everyone can come to their own conclusions about this case. PJ, I'm not a lawyer (I was a paralegal for 21 years), but I did some research into defamation of character and libel. Defamation of character or libel, classified as torts in the state of Tennessee, is a statement or act (usually published) that damages the reputation or livelihood of a person. You do not commit these torts if the statement is true and is a matter of public record. I would suggest that if you publish those names on this list you should, unless they have been convicted of these crimes, use the words "alleged perpetrators of the crime" to describe the people listed. You should make sure you get the information from a public record and not from word of mouth from someone else. I share your outrage but I wouldn't want to see you get sued.
