A few years ago I visited the Fulton Library in Fulton, KY and then we went out to your house where I used your research materials while you cooked dinner for me and my husband. I have permission from Pansy to share this; Joe Stout As an FYI will try to share the outcome of the New Hope Hope court proceedings. (One of my friends at the Sheriff's Offices refers to this as Let's Make a Deal proceedings, and for a time I felt strongly that it was all going that way and was not encouraged.) We were pleased with the bottom line. I shall try to lay it out and I feel certain that if I have anything incorrect, persons also present will let me know! Seven persons were involved, one a minor, so six appeared in court. The damage of $6,000 was reduced by a small figure which will be made up by each person serving 20 hours of Community Service (a total of 120 hours) at New Hope Church, working under the supervision of Wayne Grisson (with the cemetery association) and Gerald Nanney (the witness and person filing the complaint, and my brother) cleaning glass from the church and the outside grass, repairing the donut rutted lawn, etc., and whatever else they are asked to do. They will be required to physically clear the woods at the rear of the church and remove the discarded grave wreaths which have been accumulating there for years. Other work, at Wayne and Gerald's discretion, will be required. The physical church damages (windows, etc.) will be repaired by professionals. Each of the six will be required to pay $815 to the cemetery association, plus some $300+ court costs. One half of this must be paid when this goes back to the court Nov. 29, 3:00. The balance by a date the court will probably set on the 29th. This is pre-trial diversion, which is dependent on an FBI background check. Any prior violations will nullify this agreement. On Nov. 29, Wayne and Gerald will report to the court their satisfaction with the Community Service. Any non-compliance of the court order or report of slacking, making a game of it, or taking it lightly, by any person(s) will result in making this agreement null, and in jail time. All six persons were put on one years probation, with any violations possibly also resulting in jail time. This court procedure was ended by a wise lecture to the defendants by Judge Thomas Moore (who is much interested in history) as to the seriousness of the actions, and the need to understand that scores (perhaps hundreds) of persons had been shocked, dismayed, and inconvenienced by an act of vandalism to a place of worship, active or not. And, he did state that this was an act of justice where all persons were treated equally, regardless of who they were. Our thanks to Tommy!! He also commented that at the discretion of the Sherriff's Dept. they could have been charged with a felony which would be on their record for life. I also discovered from this that he was a Confederate Veteran that I did not have on my list. Joe Stout William A McClain served the confederate army in County H, 36 Ala Inf CSA. In William's obituary 8 August 1941-County Times, Martin, Tennessee "Uncle Billy" McClain passes Away "W. A. (Uncle Billy) McClain, 94, died Friday, August 1, at his home on Broadway ..., He was one of the 34 Confederate soldiers in Tennessee and the last in Weakley County. Up until several weeks ago, he had been in good health. At the battle of Chickamaugh, "Uncle Billy" was seriously injured when a rifle ball struck him in the chest.
