Uncle Mitch was a small man about 5' 7" he had a very long beard, he wore a Military uniform when ever company came WWI but to this day I have never found a record of him serving. He was a very smart man with lots of stories I loved to set and hear him talk, soft voice and he could make you feel like you were there in the story. But as he got older his mind stayed back in the past and later before his death he didn't speak, but he was almost 96 when he died. He and Alma had 8 children. Alma was 16 when they married and Mitchell was 32 she was also born in TN all there children were born in Oklahoma but Bersye she was born in TX and it came up a lot that she was a Texan not a SOONER there children: Era Berniece 1902 Stanton 1905 Bersye Elizabeth 1908 (Uncle Mitch lived with her till his death) Berkie Mae 1909 Bessie G 1912 Cecil Micheal 1818 Jesse Lynn 1821 Carroll 1925 I'm sure he served in WWI because he talked about it but I haven't found the records yet. First of all let me stress the fact that I am no expert on copyright law, but I did have this similar problem a few years ago when I was asked to scan the four volumes of The Jenkins Jubilee and add them to my Jenkins web site. For those that don't know..... The Jenkins Jubilee is a four volume compilation of Jenkins Surname information in newsletter format compiled, edited, and printed by Jeanne Robey Felldin. Originally issued quarterly (in 1977), it was switched to an annual format in 1978 with subsequent issues following in 1979 and 1980. Each Volume is over 100 pages!! Mrs. Felldin actually started her own printing company in order to print this and several other family surname newsletters. Realizing the copyright issue was going to be a problem, I tried several ways to determine if Mrs Felldin or family members were still living or if her printing company was still in business --- NO Luck! I then called an actual copyright law attorney and discussed my problem. My interpretation of his answer was.... Since most of the info contained in The Jenkins Jubilee (or The Smith County History Book) is "public domain" information or submitted by volunteers, part of the problem is alleviated! The rest of the problem is in the "presentation" or the "format" of the information provided. So..... if you copy EXACTLY the info and in the same format as the original info, you are in violation of the original copyright, however, while the info may be the same if it is presented in a slightly different format, you are "creating" a different work which deserves its own copyright! Now with that being said, I still agree with Charlie's statement above! In the case of The Jenkins Jubilee, I am not aware of another complete set of these four volumes outside of the Mormon Church Library in Salt Lake City. With 'my copyrighted version' of these four volumes online at my web site, they become fair game for anyone to copy, reprint and possibly sell. Still Diggin.... Gary J PS. I do understand. Of course, online content, including whole websites can also be copyrighted--though it may be harder to enforce the copyright or deal with infringement. Here's my question: How is it possible for PAY sites simply to "gobble up" the copyrighted work and SELL it to others without lawful acknowledgement and/or payment to the copyright holders? Probably because infringement is permitted with impunity. I suspect just one monumental lawsuit against just one of these sites would change their business model forever. On the other hand, it would probably cost every future subscriber more, and severely limit the amount of information available to researchers like ourselves. The subsequent question then becomes whether we're willing to do the work of compiling a (COPYRIGHTED) "Volume II/Supplement" to be made available in book form (with accompanying CD?) at a "print-on-demand" cost to those who are interested in purchasing. It should be relatively easy to determine a potential cost of such a volume based on the anticipated number of pages as a first "next step." My dear, dear late foster mom used to say: "You never turn down a good thing." My corollary to that is: "You never let evil intimidate good." Personally, my desire in proposing this project is to capture the stories that will be lost forever if we don't take the trouble to collect them now. As a published author, I'm no Pollyanna about the issue of others pirating our information for their own purposes. However, my overriding concern is less about what the unscrupulous may do with our content and more about whether what we propose to do is a "good thing." By compiling a work for print-on-demand publication, we may be able to mitigate the potential pirating issue while minimizing the potential cost to purchasers. May I propose that a committee be formed to look into these issues and the array of possibilities, and then report the findings to the group? Thoughts, anyone? I checked my Smith County Court records book and found no Willoughby's of any spelling in that either. The History of Smith Co. only mentions two Willoughby's that I can find.
