Will of Moses Phillips & Levi Phillips We, Moses Phillips and Levi Phillips make this as our last will and testament. We are the joint owners, each having an equal interest in all the land that we now own and that are hereafter mentioned and in all the personal property of every description now in our possesion, and dispose of as follows: It is our will and desire that the one that should out live the other should receive the interest of both in all our lands and personal property – the lands being refered to hereafter. After the death of both of us, then we dispose of the lands as follows: 1st. The tract known as the John Morgan tract lying in Overton County, containing acres, and in Dist. No 9. We bequeath to Polly Brown, wife of Colvin Brown, to her own separate use and control, free from any interference from her said husband. 2nd. The tract upon which we now live we give & bequeath to our niece Vice Phillips who is now living with us. 3rd. The tract known as the Jake Shote tract lying on the West Fork, & containing about 1000 acres we, also give and bequeath to our said nice Vice Phillips. After our deaths we also give to our said niece all the personal property and effects of any & every description that we may die siezed and possesed of. But the above gifts to our niece Vice are made to her upon the condition that she remains with us until our deaths and pays us that care and attention that she has heretofore.
