Fiscal Summary for HB1354 / *SB1804 Increase Local Govt. Expenditures - Not Significant Bill Summary for HB1354 / *SB1804 This bill requires owners and occupants of land where cemeteries and graves are located to grant access to the family members, descendants, and close friends of persons who are buried in such land and to genealogical researchers ("eligible persons") in order to visit and maintain graves, make burials, and conduct genealogical research. In order for a friend of a deceased person, of the family, or of a descendant or persons engaging in genealogical research to exercise the right of ingress and egress to a cemetery or to graves on private property as eligible persons, the friend or researcher must have written designation as such by a descendant or other member of the family of the deceased. This bill requires any eligible person to provide reasonable advance notice to the landowner or occupant before entering the land. This bill further specifies that entry upon the private property of another for accessing a cemetery or graves must only occur at a reasonable time, under reasonable circumstances, and in a reasonable manner. This bill authorizes landowners to designate access routes to cemeteries and graves on such persons' land. This bill requires eligible persons to be liable for any damage to property that is caused by passage across the landowner's property in order to reach a cemetery or gravesite. This bill authorizes any eligible person who is denied access to a gravesite or cemetery to seek equitable relief against the landowner or occupant in chancery court. Any owner of private property who believes a person is not an eligible person or believes that an eligible person is entering upon the property in violation of this bill could institute a proceeding in the chancery court of the county in which the cemetery or graves are located to enjoin such person from further entry upon the property. In granting injunctive relief, the court could deny further access of the person to the cemetery or graves located on the property or could set the frequency of access, circumstances under which access could occur, the manner of access, and the hours and duration of access. Carl Curt Wright Carl Curt Wright was born on March 7, 1897, in Sunbright, Tenn. On July 29, 1918, he enlisted with the United.States Army, serving with Co. B, of the 128th Engineers and June 10, 1919, received his discharge at Mitchell Field, Long Island, N.Y. Mr. Wright was united in marriage to Marie E. Jeppe, on Mar. 19, 1938, in Westfield, N.Y. by Rev. McKnight of the Methodist church. Following their marriage Mr. and Mrs. Wright made their home in Geneva, Ohio, residing there until 1941, whereupon they moved to Chicago and in 1944 moved to 707 S. State Road, Arlington Heights. Mr. Wright was active in Geneva, Ohio, as a Mason and also as a member of the American Legion. He was employed as a technical director for a large Electric Co. Mr. Wright died at the Martha Washington hospital, Chicago where he was taken following an auto accident Friday. He leaves to mourn his departure, his wife, Marie; one son, Carl Curtis; his parents, Mr. and Mrs. Herd E. Wright of Crab Orchard, Tenn.; thee brothers, Dillard, Nashville, Tenn.; A.L., Sanford, Fla., and Stanley, Crab Orchard, Tenn.; two sisters, Mrs. Georgia Silvers and Mrs. Bessie Vitatoe, both of Crab Orchard, Tenn. Services were held from the Karstens-Fairbanks funeral home following which the body to the E.R. Landon & Son funeral home, Geneva, Ohio, where final services were held Monday, December 29. I went to school with these young ladies as well. The tragedy was talked about for many years afterward and never forgotten. I understand how difficult it was for Carol to think about it again. AILOR, GLORIA JEAN MILLER - age 73 of Maynardville, went to be with our Lord, Wednesday, May 2, 2007 at Fort Sanders Regional Medical Center. She was surrounded by her entire family and numerous friends. Her kindness to others was only exceeded by her generosity and the love of her fellowman. Mom had a beautiful smile that she shared with everyone. She could even smile with her emerald green eyes. She was owner and manager of Seb's Mobile Home Park, a family business that was started in 1970 by Gloria and her husband Claude (Seb) Ailor. Long time member of Ailor Dale Missionary Baptist Church. Professed her faith in Jesus Christ at a very young age. A devoted wife and loving mother her entire life. Her unconditional love for her family and friends was endless. Our warmest memories are of the holidays Mom loved to celebrate the gathering of her family. Gardening and outdoor activities were her favorite past time. Mom helped so many people during her lifetime, she will be deeply missed by past and present tenants. Her greatest gift to her daughters was the ability to give unconditional love. In her active years she enjoyed having bridge parties with their many friends, making hummingbird mobiles which she sold throughout the world and volunteering as a pink lady at Chamberlin Memorial Hospital in Rockwood and St. Mary's Hospital in Knoxville. She was a member of the Rockwood First Christian Church (Disciples of Christ). She is preceded in death by her parents, husband, older sister Elizabeth and younger brother W. E. She was a lifelong member of Trinity United Methodist Church where she served the children of Trinity for over 30 years. Edna retired from Viskase after 28 years of service and after her retirement, continued to work at Dinner Bell in Lenoir City. She was a Girl Scout Leader for many years. ZIMMERMAN, CHARLES R. (CHUCK) - age 78 of Knoxville, passed away Wednesday afternoon, May 2, 2007 at his home. Chuck was of the protestant faith. He was a charter member and the first president of the Eagles Club #3153 in New Port Richey, FL. Chuck was a shriner, a member of the Kerbela Temple and Scottish Rite bodies, was a former past president of West Knox Shrine and was a mason. Chuck was a veteran of the US Army. He was an avid golfer and had played in many charity events. Chuck leaves behind many golfing friends. He was preceded in death by his wife Betty Zimmerman. Survivors: wife, Sharroan Zimmerman; other loving family, Walt and Jeannie Walters of Knoxville; several other family members in Florida. No memorial services are planned at this time.
