Coughran, being in a low state of health, but of sound mind and memory, and knowing that it is appointed unto all men once to die, and being desirous to arrange my temporal affairs before my decease, I do therefore make and publish this, my will and testament, hereby setting aside all former wills by me at any time made. First, I direct that my funeral expenses and all my just debts be paid, as soon as possible after my death, out of any money on hand or that may first come into the hands of my Executors. Secondly, I give and bequeath to my wife, Jane C. Coughran, all my property of every description, to be hers during her natural life or widowhood, but should my wife enter into a second marriage, then in that case, she is to have that part of my property designed by law, let it be either real of personal, except my Negro boy, Nelson, which I inherit to my wife, and she is to be the sole owner of him during her life. And as I am desirous that my family should be settled on a farm of their own, provided it don't cost more than five thousand dollars. I thereby appoint Robert Drennan, James E. English and T.B. Wiley, to purchase said farm so soon as it can be done to the best advantage of my estate, in which farm when purchased, my wife is to inherit as above directed. And lastly, I nominate James E. English, sole Executor of this my last will and testament. In witness whereof, I, James P. But if any of said brothers and sisters should be dead, then their children, if any, shall inherit their parents share. It is to be distinctly understood that my sister, Jane Coughran and her husband, James Coughran, is to inherit each one share of all my property if my wife should die childless. Secondly, I give and bequeath to my beloved wife, Sarah, my bay mare Fiddle, saddle and bridle, also one bedstead, bed and furniture. Thirdly, I direct that all the balance of my property, both real and personal, of every description, be sold to the highest bidder; my Negroes and the balance of my personal property to be sold on a credit of twelve months, my lands that lie in Lincoln County to be sold on a credit of one, two and three years; my lands lying in Jackson County, Arkansas, either with the warrant which I hold unlade, I direct to be sold privately to the best interests of my estate. I further direct that after all my debts are paid, that the balance of the proceeds of my property of every description, shall be equally divided between my wife and three children, my wife's part to be hers during her natural life or widowhood; and at her death or marriage, to go to my children. I further direct that my Executor purchase a small piece of land for my wife, suitable for her to raise my children, and land to be paid for out of her share of my estate. And lastly, I do hereby nominate and appoint John T. Coughran and Robert Drennan, sole Executors of this my last will and testament. First, I direct that my funeral expenses and all my just debts be paid as soon after my death as possible out of any monies that I may die seized of or may first come into the hands of my Executor. Secondly, I direct that all my personal estate be sold on a credit of twelve months and the proceeds to go first to the payment of my debts, and the balance, if any, to be paid over to my mother for her own special use and benefit. But I further direct that my mother shall pay one half of the above named balance of these proceeds to my sister, Mary Ann, to be hers forever. Thirdly; I give and bequeath to my mother, all my land, to be hers during her natural life, and at her death to be sold, and the proceeds divided as follows: brother, Manson to have one hundred dollars; brother Abner to have fifty dollars; and my two sisters; Mary Ann and Sarah, to have one hundred dollars each. And then the balance, after all expenses are paid, to be equally divided among the above named legatees, and all the rest of my brothers and sisters.
