    1. [TNHAMILT] Deeds to Land Govt gave to Cherokee
    2. Ron McCandless
    3. Euline and other researchers with possible Cherokee/Delaware Heritage: I have at different times posted queries about a law suit that involved land that was deeded to a Cherokee Family by the US Govt in either Chattanooga or in Dist. 6 of Marion Co. No one could identify any programs that did that. I called Kent Carter of the NARA facility in Ft. Worth because they have most of the Cherokee records (all the five civilized nation in fact) BUT I was told that they had no idea about this land program but since it was on the Eastern Nation (before 1880) the information may be known at the Atlanta NARA facility. I called there and had an audience of at least five people on the speaker phone and no one knew of a program that would involve those parameters. I continued my research stopping short of calling NARA's expert in Washington. The two groups at Ft. Worth and Atlanta were both very helpful and very knowledgeable but this was beyond their normal scope. >From the web page http://freepages.genealogy.rootsweb.com/~harrisonrep/Johnson/JHN1196part3.htm Citing the book by David Keith Hampton,CHEROKEE RESERVEES (Oklahoma City, OK; Baker Publishing Co.,1979) p 1.1. The Cherokee Treaties of 1817 and 1819 were important in Marshall Co. History. The 1817 treaty was a major attempt to resettle the Cherokee peacefully in the West. It gave them title to lands in Arkansas in exchange for an equal tract of land in the east. Since many Cherokees with lands in the east would not want to move, provision was made allowing each head of a Cherokee family who wished to become a citizen of the US to receive a life reservation of 640 acres, with reversion in fee simple (absolute title to his children with the stipulation that removal from the reserved land would result in title passing to the US. That meant that they could not sell the land or hold on to it if they moved elsewhere but that their children would have such rights after the parent died (This following paragraph seems to be from the author of the web page's information) There was dissatisfaction over this treaty and so in 1819, the US agreed to pay for improvements left by the Cherokees who vacated their homes in the east. Hampton in the book cited gives several very interesting lists. A register of persons who wished Reservations under the 1817 treaty had 311 names. 31 persons are shown who were granted land where they resided, and nine listed on land other than where they resided. (Does this mean that Thomas was of Marion County TN but got his reservation in Madison County, AL?... or were there two Thomas Harrison Reservations for two different people?) Under DOCKET OF APPLICATIONS filed for adjudication with the Board of Commissioners to settle claims under the 1817 and 1819 treaties were 140 names. Most interesting is a list of 1229 abstracted claims acted upon and decided by the fourth Board of Commissioners under the treaty of 1835-36 showing the amount claimed. Among those listed are Catherine Cheek's children, Polly Smith's son Walter, James Ore, John Thompson's heirs, THOMAS HARRISON'S HEIRS, and Catherine Stephens. This shows clearly that there was such a program and the land was deeded to the Cherokee head of the family. I need to know if anyone else has found deeds of this nature in Marion or Hamilton Cos. in Tennessee? Ron McCandless

    1. [TNHAMILT] James M. Smith - b. about 1809 GA or TN
    2. Kathleen Burnett
    3. Dear List Members, My head is getting bruised from banging it against my Smith brick wall. This has been going on for years and I don't seem to be making a dent. Thought I would again send out a query and see if anyone has run across this Smith Line. I first found James Middleton Smith in Hamilton Co., TN in the 1830 U.S. Census, with what seems his new bride in the house hold. (Susan Wallen b 1809 in Lee Co., VA) There are no children in the home. Living close to him was a Charles Smith U.S. Census 1830 Hamilton Co., TN - 10000001-0000001. In 1850 James and Susan are living at Lookout Mountain, Walker Co., GA with their family, as well as a Littleton Smith who I am guessing is a brother due to the fact Littleton and family will migrate with James and Susan between 1850 and 1860 to Randolph Co., AR. They are living in Cach, Randolph Co., AR. The children of James and Susan are as follows: William Smith b. abt 1830 Hamilton Co., TN, married a Margaret, sometime after 1850. In 1850 he was 20, single living with his parents. Sally Smith b. abt 1832 Hamilton Co., TN, have not been able to trace her in the migration to Randolph Co., AR I think she married in Hamilton Co., TN or in Walker Co., GA. Mary Smith, b. abt 1934 Hamilton Co., TN, married Samuel Sammons before migrating to Arkansas. Settled in Randolph Co., AR with rest of the family and remarried after the death of Samuel Sammons to Robert C. Stout. Priscilla Smith b. 18 Feb 1836 Hamilton Co., TN married William M. Stout about 1854 and migrated to Randolph Co., AR with her parents. Campbell Smith b. Jan 1839, Hamilton Co., TN married Angeline Davis in Randolph Co., AR Nancy Smith b. abt 1840 Hamilton Co., TN, no proof of marriage - migrated with parents. Caroline Catherine Smith b abt 1841, Hamilton Co., TN, no proof of marriage - migrated with parents. Martha Smith b. abt 1844, Walker Co., GA, no proof of marriage - migrated with parents. Tennessee J. Smith b. abt 1848, Walker Co., GA, married William James Sammons in Randolph Co., AR and married second time to the husband of Mary, her sister after Mary's death, Robert C. Stout. Henry Smith b. abt 1859 in Randolph Co., AR. Henry was last child of Susan Wallen Smith. She died fair shortly after his birth. James Middleton Smith married a second time in April of 1863 to Mary C. Morris of Randolph Co., AR. As for Littleton Smith he is also living at Lookout Mountain, Walker Co., GA in 1850 with his wife Bathsheba and two children, Elzy H. Smith b. abt 1840 and Mary A. Smith b. abt 1847. Littleton and Bathsheba were living in Randolph Co., AR by 1860 but both of her children are gone. If anyone knows of this family I would appreciate hearing from you. Kathleen Burnett

    3. We are getting ready for our trip to Hamilton Co to do research next week. In going through my material I found an old map of cemeteries; the cartography was done by the TVA. But it is a bit confusing I find 2 SPIVEY cemeteries in Hamilton co and 1 SPIVEY cemetery in RHEA county -- at what looks like the new bridge. >From the TVA's notes SPIVEY 1 and 2 has the following notation: Disinterment cemetery; Flooded cemetery; and Cemetery investigated. SPIVEY in Rhea Co has no notation. Is anyone familiar with these cemeteries? Why are there three SPIVEY cemeteries? Any help /advise appreciated. Phebe Morgan
