I think Danny took parts of the proposed bill out of context. Can any one say "Henny Penny"? (GRIN) Here is the ENTIRE bill. Be sure to read ALL of the first paragraph, especially that part that was left out by Danny, the part before "In order for a friend of a deceased person, of the family, or of a descendant or persons engaging in genealogical research..." The way I look at the bill is that owners of property that contains family graveyards MUST give access, not that such owners can restrict access. Note the words "requires" and "genealogical researchers ("eligible persons")". Regards, Sarge HB1354 by *Jones S. (*SB1804 by *Jackson, *Marrero B.) Cemeteries - Authorizes eligible persons, including family members, descendants, and friends of the deceased persons and persons conducting genealogical research, access to cemeteries and graves on private property, subject to certain limitations. - Amends TCA Title 46. Fiscal Summary for HB1354 / *SB1804 Increase Local Govt. Expenditures - Not Significant Bill Summary for HB1354 / *SB1804 This bill requires owners and occupants of land where cemeteries and graves are located to grant access to the family members, descendants, and close friends of persons who are buried in such land and to genealogical researchers ("eligible persons") in order to visit and maintain graves, make burials, and conduct genealogical research. In order for a friend of a deceased person, of the family, or of a descendant or persons engaging in genealogical research to exercise the right of ingress and egress to a cemetery or to graves on private property as eligible persons, the friend or researcher must have written designation as such by a descendant or other member of the family of the deceased. This bill requires any eligible person to provide reasonable advance notice to the landowner or occupant before entering the land. This bill further specifies that entry upon the private property of another for accessing a cemetery or graves must only occur at a reasonable time, under reasonable circumstances, and in a reasonable manner. This bill authorizes landowners to designate access routes to cemeteries and graves on such persons' land. This bill requires eligible persons to be liable for any damage to property that is caused by passage across the landowner's property in order to reach a cemetery or gravesite. This bill authorizes any eligible person who is denied access to a gravesite or cemetery to seek equitable relief against the landowner or occupant in chancery court. Any owner of private property who believes a person is not an eligible person or believes that an eligible person is entering upon the property in violation of this bill could institute a proceeding in the chancery court of the county in which the cemetery or graves are located to enjoin such person from further entry upon the property. In granting injunctive relief, the court could deny further access of the person to the cemetery or graves located on the property or could set the frequency of access, circumstances under which access could occur, the manner of access, and the hours and duration of access. Any person who enters upon the property for accessing a cemetery or graves who is not an eligible person would be subject to all remedies provided by this bill and any other applicable provision of law. My Dobkins family intermarried with Peter Johnson/Johnston's girls. This was in Shenandoah/Augusta Co., TN. These two Dobkins men migrated to Washington and Greene County, TN in the late 1780s, early 1790s. I don't have much on them at all, but am always looking for information on the Johnson/Johnston family of Virginia and TN. Carol Dobkins Keith email: [email protected]
Searching early-day Johnson family. There are four Johnson men listed on the 1783 tax list: James, John, Joseph and William. Would like to make contact with anybody searching any of these men. Can anybody tell me if the records in the book, "Tennessee's First Settlers & Soldiers" by Edward C. McAmis are from Greene Co. area? There is an entry for one John Johnson which reads: "Johnson, John, b/c 1780 - 1790 today's Gr. TN. 1st wife unknown, 2nd wife Lovely Pullan or Pullin (Puller?). Does anybody out there connect to this John Johnson, his siblings, or in-laws? If so, would like to make contact. Nancy and Thomas are my husband's ggg-grandparents. Thomas Gilton was a blacksmith, b. in Virginia about 1816, and appears in the Censuses in Greene Co. from 1850-1870. According to the death cert, Nancy Carter was born on January 11, 1835 in Greene County, Tennessee and died July 24, 1915 in Washington Co., TN. Her parents are listed as William Carter and Fannie Carter. That implies that Fannie's maiden name was also Carter, but it's also possible that whoever gave the info didn't know her maiden name, and just gave her married one. I haven't traced William in the censuses--I think there's one in 1840 in Greene Co., but he doesn't have a girl child of the right age to be Nancy in the house. Fannie, however, appears in as Head of Household in 1850 (as Fanny Carter) and 1860 (as Francis Carter). She was born in about 1801 or 1802 (48 in 1850, 59 in 1860), either in Tennessee or Virginia. Besides Nancy, she had at least two other children: Henry, born about 1836-1838 (age 14 in 1850 and 22 in 1860) in Tennessee; and James, born about 1841-1843 (age 9 in 1850 and 17 in 1860). Henry in 1860 lives next door to his mother with his family, including a wife named Sarah (age 30) and three children: Noah (4), Hugh (3), and James (11 months). Is anyone working on this Carter family? I would love to learn more about William and Fannie Carter, and whether Nancy had other siblings besides Henry and James. Thanks!
