    3. This MAYES is one of mine. I'm descended from Edward through his son James G. and James G.'s son Eli. James G. married Martha McDANIEL and Eli was undoubtedly named for his maternal grandfather Eli McDANIEL. The document is apparently part of how the heirs settled the estate and distributed property after Edward's death. I'm in touch with another descendant of one of James G.'s children (through James' son Jerry), and we're still not sure who Edward's parents were. I'm still working on documenting Eli, so I haven't really moved back to the James G. generation yet -- or Edward. BTW, we refer to this James as "James G." as there are other James MAYES about Grainger Co. and Tennessee and it's not hard to get them confused. Gail, I've seen transcripts of this document before, but never an original -- would you be willing to mail me a copy if I sent you my address off list? Or if you have it scanned, to e-mail me a copy? John McCarty BTW was one of the signatories on the petition who WOULD have been over 21. He was born September 27, 1775. This is from John and Elizabeth Mayes family bible. No one has seen this bible for awhile, but a researcher I know has a copy of the information. Some years ago a fellow researcher and I thought we might teach a begiiner's class (we never got around to it). I thought it would be a good to practice ordering someting through Persi. I never had so I ordered a trancription of the McCarty family Bible in hopes of learning more about the Bible. The article I recived was a transcription of an older familily Bible once owned by James McCarty who was born in 1736. It BTW gives the same birthdate for John McCarty September 27 1775. I turned to my husband and said, "Gee the McCarty's really ran to family bibles! Is this fair??? I have varying and conflicting year dates for the birth of John McCarty's brother-in-law, Benjamin Ivy, my ancestor. (I often meditate on the paucity of my information compared to other researchers. Is this FAIR!! <grin> I am nevertheless reasonably certin that Benjamin Ivy was NOT 21 in 1806.     3. I'm not familiar with the original document. If it's essentially just a petition (a letter making a request) then I suppose anyone could sign it. If it's some sort of legal document then probably one had to be at least 21, if not also a landowner. Just like today, different people are eligible to sign different sorts of things. "Please sign our petition to ask the city council to change the hours the gates are open at the park." vs. "Are you a registered voter? Would you like to sign the petition to nominate Joe Smith for mayor?" The first group could be anyone -- 10 years old from the little league team, whoever. The second group would have to fit into the local laws defining who can nominate someone for mayor. So is this document saying "We the undersigned would like a road." Or is it saying "We the undersigned "eligible persons" formally request the state to provide a road on the described route." Or "We the undersigned people who farm or own land agree to grant right-of- way for a road on the described route." Read up on Tennessee law, probate (the rules changed over the years) etc., BUT is everyone CERTAIN that one had to be a landowner in order to sign a legislative petition. I think a little "fudging" was involved by the petioners as far as age..at least those I know..HOWEVER are we certain that one had to be a landowner???     3. That's the second half of the list of names on the petition. The first half appeared the previous issue which wasn't in the NWMGS library. The Ansearchin magazine sppeared to have been donated. I don't think the library has a subscription. As I have already said according to tax lists several of these young men owned no land in 1806. Later they did own land. They bought it or inherited or their fathers turned it over to them. Despite the fact that John Ivy's tombstone in Economy says he died in in 1868 in his 85 year. Elizabeth Ivy Consort of 1880 in her 95 year.. (these are indeed their DODs I have the the exact dates.) It is generally agreed that John was the youngest Ivy. Neither John nor his wife were anywhere close to 85 or 95 when they died. A fellow Ivy researcher and I once traded a series of hilarious letters on the various dates we had for the Ivy (Ivey) brothers births. If we move them around according to dates Benjamin becomes older that Thomas etc. "Maybe they were twins." I guess they could have been <grin>..or sometimes they become triplets. Jane Howell Ivy said in a deposition in Henry's Revolutionary pension file that they kept NO record of the birth of their children.... However, although the dates vary the brothers would have been Phillip, Thomas, Benjamin and John No other brother becomes older than Phillip. Phillip WAS the oldest. Robert Alison Iveys book says Phillip Ivey was born 1780. So does George Franks Ivys Iveys in the United States (A really fascinating feature of this book is that it has my line in it twice although this is not immediately apparent on the surface! <grin>) In a deposition in Henry Howells Revolutionary person file in her sister-in- law Jane O. Collins Howells behalf Jane said Phillip was born in 1783. My records indicate this date. Now remember in Henry's file said they kept NO record NOT that she didn't KNOW. Jane was Phillip's mother..a mother would know wouldn't she. <smile> Sorry for this long dissertation but neither John Ivy or Benjamin were I think 21 in 1806. And I don't think Dudley Mayes was 21 either. IF he was 21 he was barely 21. Jesse Hodge could have been 21. Neither Jesse or Moses lived long enough to be on the 1850 census. I thought that both Jesse and Moses would have been in their mid 20s in 1806. However, Jesse was a little younger than I thought and is still listed as a male aged 16 to 26 on the 1810 census. I also looked on the 1805 tax list and several of these young men were not taxed not even as 1 fee poll. As I said years ago when I encountered this document that a little fudging was involved. As I said before I think they REALLy wanted this road change. This is not to say I don't think the document has no value. I copied and keep it in the same notebook as I keep my taxlists information. It is I believe to a certain degree a guide to the age of the petioners. A researcher located this list through a rootsweb search. Although I know nothing of the William Webster on the list of petitioners and she didn't have an exact date just a circa we could pretty well eliminate her ancestor as being the William Webster on the tax list. The younger Pleasant is named in the settlement of the estate of Miller Easley, father of Susanna, 1846 in Grainger. Regarding Moses Collins- he is listed on the 1830 and 1840 census of Claiborne Co., Tn. A Moses Collins married Elizabeth Atkins 10 March 1850 in Grainger Co., Tn. I believe this Moses is listed on the 1860 census of Claiborne Co., Tn., 6th sub-div Tazewell- Moses Collins 58, Elizabeth 25, Louverna 3, Milam Shiplet 23, Jane 28, John 3, Mary A. 6/12 1850 census Claiborne Co., Tn #1021-1021 David Collins 60, b Va, Phebe 50, b Tn, Cassa 35, b Tn, William D. 3 b Tn.     3. Can anyone tell me if the lists of names Gail posted for the 1806 legislative petition just consisted of property owners? I am certain they all had to be over 21, but did they also have to own land to be able to sign this petition? Thanks, Eleanor
