    1. Obituary for Hershel Lee Miller
    2. Hershel Lee Miller was the son of William Ernest Miller (b. July 25, 1911, d. July 12, 1978) and Lora Mae Hall (b. June 08, 1915, d. April 30, 1984) -- both buried at Hanging Limb Cemetery in Overton County. Lora Mae Hall was the daughter of Andrew Burton Hall and Ova D. Owens, who are both buried at Campground Cemetery in Fentress County. ---------------- MONTEREY -- Funeral services for Hershel Lee Miller, 58, of Kaneohe, Hawaii, will be held Saturday, Sept. 9, at 12 noon at the chapel of Goff Funeral Home. Burial will be in Phillips Cemetery in Hanging Limb with full military honors provided by the Veterans Honor Guard. Family will receive friends Friday, Sept. 8, from 6-9 p.m. at the funeral home. Mr. Miller died Friday, Sept. 1, 2006, at his residence following an extended illness. He was born April 6, 1948, in Overton County to the late William Earnest and Mae Hall Miller. He was the sixth of eight children. Mr. Miller was retired from the U.S. Custom and Border Protection, having served as Port Director in various locations, including Detroit, Guam and the U.S. Virgin Islands. After graduating high school in Red Key, Ind. in 1966, Mr. Miller volunteered to serve in the Army. He served a total of three years of active duty, one of those being in Vietnam, where he was awarded two Purple Hearts among many other medals. After completing his service, he furthered his education. He then went to work for the Justice Department. Later, Mr. Miller was employed as a Port Director with the Department of Immigration and Naturalization, now known as Homeland Security. Although he had many posts all over the world and had to be away from his family, they always supported him in his endeavors. He spent his entire life working to make the U.S. a safer place. After retiring, Mr. Miller settled down in Kaneohe, Hawaii. His family includes his wife, Phyllis; two daughters, Amy and Joy Hayashida, both of Oahu, Hawaii; four brothers and three sisters-in-law, Arthur Dee and Myma Miller of Monterey, Harold and Phyllis Miller of Crawford, Paul and Sheila Miller of Cookeville and Mark Miller of Monterey; a sister and brother-in-law, Betty and Bob Sharp of Monterey; a sister-in-law, Velma Miller of Monterey; and a plethora of nieces, nephews, grandnieces and grandnephews. In addition to his parents, Mr. Miller was preceded in death by a brother, Alvin C. Miller, and a sister and brother-in-law, Arlene and Bob Roberts. Pallbearers will be Jack, Randy, Scott, Rex, Dee, Ben and Alan Miller, Doug and Mitchell Roberts, Jeff Sharp and Gareth Tokunaga. Memorial donations may be made to the American Cancer Society through Goff Funeral Home or to Hospice Hawaii, 860 Iwilei Road, Honolulu, Hawaii, 96817-5018. Bro. 3. I disagree, In that case every obituaray that has ever been printed would not be able to appear on-line. However, I do agree that posting some information on living individuals is questionable. As I live in Germany, far away from any library or court house record in the USA, I primarily research on-line so 98% percent of my findings come from the internet. It is my view that if it has been printed to the public in a newspaper then it is public property and can be used. If it was generally held that no information about a living person can be made public then: -marriage & engagement announcements (common in all newspapers) -birth announcements (common in all newspapers) -death & obituary announcements (Like Jennings Funeral Home) Would not be possible. I for one would not like to see these dissapear from newspapers...would you? 2. Anna Bertram
    3. Peggy, Having been instrumental in the saving and ongoing maintenance of a historic old cemetery in White Co., TN, I have learned a lot. First, there are no government monies for maintenance of private cemeteries in TN. There are laws that permit relatives and descendants to visit and maintain the cemeteries. There are also laws that empower local courts and law enforcement people to enforce the TN Cemetery and Burial Laws, but the results are quite inconsistent and usually reluctantly followed or flatly denied. Diplomacy, compromise, and sweat equity, however, have worked for us in White County rather than law enforcement. The cemetery in White County, TN is the burial site of William BUTRAM, II, who is the ancestor of all the BERTRAM descendants in Fentress Co., TN and surrounding area. Here are some links to websites that should help you. The third one can be downloaded in pdf format if you have free Adobe software. (From almost any government website.) http://www.savinggraves-us.org/tn/index.htm http://www.tngenweb.org/law/cemetery-law.html http://www.davidsoncocemeterysurvey.com/Tennessee%20Cemetery.pdf#search=%22TN%20Cemetery%20laws%22 Good luck! Sincerely, Anna Bertram abertram@heartoftn.net Peggy Yates Riley smriley@indy.net wrote: It has recently come to my attention that older, rural cemeteries like the one at Bill's Creek are not always being maintained. Apparently individuals who had been mowing the cemetery found it easier to collect the stones and stack them to the side and then mow. After mowing stones were returned to positions on the graves. This may explain why my father always insisted that many of the stones were not where they should have been when we went back to visit. Does Tennessee have any type of program that allows for state funds to be used in the maintenance of these older cemeteries? Or, is it the family members' responsibility to maintain these sites? If this task belongs to family members, can anyone suggest a reputable firm for mowing and maintenance?

    3. Peggy, I don't know about the availability of state funds for the maintenance and care of old cemeteries, but I can answer your other question re: is there a record someplace of each name, date of birth and/or death, and place in the cemetery? Answer: Mabel Wheeler compiled a book Cemetery Records of Fentress County Tenn, copyright 1988. It lists the names of about 60 persons buried in Bill's Creek Cemetery and states that there are many field stone markers with no writing on them.
