You know, in answer to this, why expect the landowner to furnish the fencing materials (try pricing fence posts and wire) and the labor (if you can find someone to do it) to fence in someone else's property? Have you and your family members considered approaching the landowner with an offer to pay for and build a fence around the cemetery? It seems a little silly to first think of taking a person to court simply because he owns the land surrounding a cemetery that no one in the family cares enough about to maintain. This is just my two cents worth, but I have been on both sides of that fence.
