Jean in TX - I can understand what you are saying but we must protect our cemetery's and our heritage. I became aware of my ggg grandfathers cemetery just this year. I found it thanks to a genealogist who answered a query I had written. Even though I lived within 12 miles of the family cemetery I did not know it existed not had any of my family ever discussed it. I made a trip to my home town Mayfield Ky. in early August with the purpose of finding the Jones Family Cemetery. It contains only 7 graves. Thanks to a good friend who helped me search and a old map from the early 30's we found the cemetery. It was overgrown with weeds and a huge cedar tree had fallen through the cemetery knocking all of the markers off of their base. Some were covered with dirt and we had to use a probe to find the headstone. The cattle could roam through the cemetery. I plan on going back this fall and plan to attempt to reconstruct the cemetery, see if the headstones can be remounted on their base, and to have them cleaned. If necessary I will erect a fence if the landowner will not do so. He said he was aware of the cemetery but had not viewed it in several years. He advised he would help with the problem. The oldest grave in the cemetery is my gggg grandmother Jane Jones who died March 18, 1856. She was born in Dickson Co. Tn and moved to Graves Co. Ky. in March of 1850 with her son and after her husband John John Jones had died.d Lets preserve our heritage even if it cost a little. In Texas a rancher/farmer is required to fence in a cemetery if it is land-locked. However this sometimes presents a big problem for the rancher/farmer as he is not required to keep it mowed down, etc. (nor should he be if it is not his family's cemetery)---therefore it becomes a haven for snakes and other critters which can be a potential danger to his cattle---especially the calves. As expensive as cattle are you can see why he might not be so open to maintaining a fence in such a situation. In many situations he cannot find family members who are willing to keep the tall grass and weeds from growing up. It should not be the place of someone who bought land some 50 years or more after a cemetery has been established to maintain that cemetery. That is why it is so important for family members to form cemetery associations to not only maintain the cemetery but to keep someone from allowing their cattle in among the stones as their dainty little feet can really destroy a cemetery in a hurry! Then too, most cemeteries are among trees and cattle just love to sit among the stones where it is shady and cool and lean on them! Sharon, I just started on the family tree and Granny (Ann) was giving me info, she told me all that she knew but said she would talk to Aunt Ruth, and that's been a couple of weeks ago. Debbie visited us, here in Mexico, last weekend. While she was here she gave the Brothers and Sisters for Shug. So basically that is what I have plus the Children, grandchildren and great-grandchildren for Shug and Anne. Our son James Enman Herbison is the 1st great-grandchild for them, he was born on Dec. 23 of 2000. I am willing to share all of my info. Just let me know what you need. Michelle
We need to remember to change the subject line of our messages when we reply and the subject has changed.
You know, in answer to this, why expect the landowner to furnish the fencing materials (try pricing fence posts and wire) and the labor (if you can find someone to do it) to fence in someone else's property? Have you and your family members considered approaching the landowner with an offer to pay for and build a fence around the cemetery? It seems a little silly to first think of taking a person to court simply because he owns the land surrounding a cemetery that no one in the family cares enough about to maintain. This is just my two cents worth, but I have been on both sides of that fence. Michelle- I have done some research on the Gilmers and Martins. Received a lot of info from people on this list and some from people in other forums.. If you have a lot of info it would be greatly appreciated. Seems like only Aunt Ruth knew very much and she wasn't wanting to share for a while. I also have some info on the Peelers which are family of Thomas Levi's Mother. Sharon
Doug - Talk to your county judge or county prosecutor or even your state rep. They may be able to help you, perhaps even take the landowner to court. Worth a try. Have you personally talked to the landowner in a very nice way and expressed your concern. Sometimes people are not aware they are creating a problem. Good luck. Do you have a Maggie Bell in your line? That was my great-gf 's 1st wife. His name was Alexander Hendrick. They married in Montgomery Co in 1864. I don't know what happened to her, they had one son named Robert, then he married Agnes Mayes who was my gm's mom. I have them on the 1880 census in Dickson Co. She's not really a blood relative, just curious about her. Thanks, Sharon
No, I am sorry. My George married my gg grandmother's sister who was a Troublefield. I am trying to find out when she died. I know she was living in Dickson in 1907. Sorry I could not help you. Has anyone info on the parents of KEZIAH ' SPICER ' HAND ? From old info I have she was born abt. 1795 in Georgia. When she married, I know she lived close to some Spicers in Dickson Co. I would appreciate it if anybody knows who and where her parents were from, they'd let me know. Thanks Bette
There is a website where you can get the laws governing cemetery and burial sites in Tennessee. It is: http://web.utk.edu/~kizzer/genehist/research/cemetery.htm This site contains all the statutory laws governing Cemeteries. If you aren't successful in locating what you are looking for, let me know and I will send you copies of what I have. And landowners can be forced to fence and maintain a burial ground on his property, and also allow a right of way or access to the families of the deceased buried on his property. Betty Collier - I am told in some states that the landowner must fence a graveyard before he allows cattle or any type of livestock to roam through the cemetery. You may want to check to see if this is true in Tn. and maybe you can get the problem solved. GOOD LUCK. YOU WOULD THINK PEOPLE WOULD BE MORE CONSIDERATE.
