The ones I checked were proven in the Commonwealth of Pennsylvania and this probate was written along with the deed into the Davidson County deed book. In deed book C, page 107, the probate stated that Innskeep and Lardner Clark by his attorney Elisha Clark appeared before William Brasford a Justice of the Commonwealth of Pennsylvania to acknowledge "the above their act and deed"... The scans that I am viewing are poor quality but it appears all the deeds in book C witnessed by Innskeep and Kerlin were proven in Pennsylvania. It did not appear that Kerlin came before the Justice to confirm his signature, only Innskeep. The deed recorded in deed book C, page 107 was written on Jan. 14, 1792 and proven or probated, which was a verification of the signatures, on Jan. 26, 1792. Kerlin and Innskeep witnessed the signature of the grantor on Jan. 14, 1792 and Innskeep appeared before the justice on Jan. 26, 1792, to say that he had witnessed the signing of the deed. The law probably only required the oath of one witness to prove the signature of the grantor and it happened to be Innskeep. The deed and the accompanying probate (which had been signed a year before) were recorded on Jan. 3, 1793 in Davidson County. The witnesses were in Pennsylvania when they signed the document. 3. George I will try to help but need to know the names of the buyer and seller listed in the deeds or a deed book and page number. Vol. 6 apparently refers to the 6th volume of the published book. Deed books for that time period carry letters rather than numbers. 3. Perhaps someone can verify this for me but this may shed some light on George's query ---- I believe the deed itself was witnessed at the date of the deed - not when it was recorded. Years could go by without an official recording of the deed itself. SO....the witnesses would have been in the presence of the deed transaction when it occurred, not when it was recorded. In every case that I have seen, the deed has a date and the recording of the deed has a date and they are usually not the same date. These deeds are transcribed in a book, Davidson County, Tenn Deeds Vol. 6 (Dec 1791-Apr. 1793) transcribed and typed by Laura Willis. Pub. by Simmons Historical Publications, 1998. My question is whether these two testators were physically present in Davidson County to witness the recording of these deeds. Some of the deed records are folks in Monmouth County New Jersey, or Philadelphia and a person living in Davidson County. 3. One additional item to note ... the witnesses are confirming that the seller is indeed selling the property, so they would be present where the seller of the land is located. If some one in Davidson is selling land to someone in Philadelphia, the testators/witnesses would be located with the seller in Davidson. At some point in the future, when the deed is recorded, either the seller or the testators will be called upon by the Davidson County court to attest that the deed represents a valid transaction. So yes, Inskeep(er) and Kerlin were located in Davidson.
