The following will I transcribed from microfilm and some words were illegible. Carter Co. TN Will Book 2 Pages 47-48. Monday March Term 1872 Then was the Last Will and Testament of Samuel B. PATTERSON was exhibited & Read in Open Court and proven by R. A. Smith & H. M. Folsom the subscribing witnesses thereto, which is in words and figures as follows. I Samuel B. PATTERSON of the County of Carter and State of Tennessee being of Sound mind and memory but realizing the uncertainty of this life, do make publish & declare this to be my last will and testament, hereby revoking all former wills made by me. First. In humble acknowledgment of my belief in God I give my Soul to him to be desposed of according to his good pleasure & request that my body be decently buried in a Christian like manner by my family. Second. It is my will that the expenses of my burial with the just debts that I may owe at the time of my death be paid by my Executors herein after to be named. Debts from any of money _____ or other chases in action I may have at that time. If the funds arising from these sources should not be sufficient to pay my said Funeral expense & debts I desire that my Executors sell personal property I may own at the time of my death to raise & sufficient funds for that purpose. Third. After the payment of Debts I will give and bequeath to my wife Catharine Patterson all the remainder of my personal property of every kind and description excepting the special bequests, to my wife herein after made to him absolutely to and dispose of as she may see proper. Fourth. I will give and devise & bequeath to my nephew Nicholas CARRIGER all my Carpenter tools of every kind & description. Fifth. I will give bequeath & devise to my beloved wife Catharine PATTERSON the following tract of Land to wit: the home tract upon which I now live in Carter County, Tenn., containing Seventy five acres more or less, the tract adjoining this tract purchased of by me of R. R. Butler, also containing Seventy five acres more or less & the tract purchased by me of Peter W. Emmet adjoining the home tract above named &c containing Thirty Seven acres more or less to hold possess and enjoy, each of said three tracts of Land for & during the time of her natural life. Sixth. At the death of my wife Catharine, I will give and divise to my nephew Nicholas CARRIGER the said three tracts of Land above described to my said wife Catherine for life, to be his absolutely at her death, but upon the express condition that he the sd. Nicholas does not either before or after my death intermarry with one Sarah J. SIMS widow of Hiram, Decd. & formerly Sarah Jane KITE whom I reguard as a woman of bad character & might be his wife. If the said Nicholas should at any time violate this condition by an intermarrying with said Sarah Jane SIMS then this devise to him is to be void and I will give and devise the said three tracts of Land at the termination of the life estate herein of my wife Catharine to the children of my niece Martha Hyder wife of Joseph HYDER & the children of my niece Eliza Jane HYDER wife of James E. But the devise of these two tracts to said Nicholas is upon the same expresses conditions that he does not intermarry with the said Sarah Jane SIMS & if he should at any time violate said condition by intermarrying with her then this devise to him is to become unoperetive and void and I will give & devise the said two tracts of Land herein described to the children of Martha HYDER and Eliza Jane HYDER in the same maner & upon the same time as apply to the other conditions I bequests to them contained in the Sixth clause of this my Last Will. TN Will book 2. This was on a roll of microfilm and I had trouble reading a number of the words, but found it interesting. Carter County TN Will Book 2 Page 30-31 Monday, May Term 1863 William Cass came into open court and brought with him a Letter from Robert Cass dated at Corinth Miss. April 4th 1862, which letter reads as follows. Coirinth, Miss. April 4th 1862 Dear Brother, I Rec'd. your letter of the 28th March on yesterday it was mailed in EBton the 31st came to hand on the 3rd a quick trip. The letter you spoke of stating to me I have not reed yet I was much pleased at getting a letter from you any time more but hearing of the health of Little James is truly concernable to me but I hope he is at Rest in heaven where the [illegible] and trouble of earth will cease to perplex his unmortal soul, spirit. We must all die and I hope we may meet in a world not like this but far better and preferable. Your letter gave me much ease of mind as I had come to the conclusion that we would not get letters any more from East Tennessee. The battle you spoke of I had seen an account but the battle(?) Col Carter mater was perfect news to us. Well shell will not get war it in a month. the boys that came here from Carter are all well at this time. Livingston and Green enlisted for two years. Our Captain attempted to reorganize his company in the 2nd ! of this inst. but failed. He only got 9 out of 92 to reenlist. They want to get home as bad as my set of men. You ever saw the Federals run 150 transport Boats up the Tennessee River. Last week with 220 thousand troops and of course it is to take this place it is only 20 miles from here to the river and they advancing upon us. Ran(?) of pickets in Twell(?) yesterday there was a wonderful stir and moveing at and about Corinth yesterday and last night. Moveing out to meet the Feds, Our company is held in reserve whether we will get to see any of the fun or not grant? to tell. By my opinion is there in a week or ten days we will see and feel some thing about it. The Feds captured three hundred men and hundred horses and a vast amount of stores at [____] city last week. Our Captain Jackson and Col. Was there it is thought they got they steped in on over flank the other day and stoled off two Redgiments. Truly they are playing Yankee tricks on us at every place. What is! to become of us I do not know poor fellows we must do the best we can the Yanks will get all of us before they quit I do caput?. I will now attempt to answer the business part of your letter and I am at a loss to know how to begin it as I cannot have the things done according to law. I am in [_____] if I was in Tennessee I might get a Lawyer to thought out the processings that would be Legal but placed under the circumstance that I am I cannot have it done I would prefer selling if I could have things done right and a mortgage. I would be willing to do that but it would require a Security proceeding in law and if Mr. Slagle was to sell to go it might involve the thing more than it is at present, and I have the utmost confidence in Mr. Slagle. He will or would surrender his claim in your hands at any time, therefore I will say to you that if any thing should happen to me that I never return home, I want you to take my business there and wind it up the best you can administer upon my Estate and pay the debts and wind it up and sell it and what is left after paying off I wish those Little Boys at T He! atherlys to have the benefit of One half of it and I want it to be laid out in Schooling of them. Regarding the other half after expenses are paid I want yourself and Little Bob Cass, I [___] Little Bob to have. I am just giving the desire of my mind in short the things will have to be done according to law and this Sort of Settlement in my own hand wrighting is as good as if I had the form and wright it in full. Tell James I want him to let my Little boy have some means as he may need it untill I can come home and let him know it is my request as I promised to send him some money I owe James and of course he want a part or all of it. Could someone find a death notice for Arthur Hopson?? He was born abt. 1916-1918 and died about 1933-1934. He was born in Johnson City TN. And died there. He was my Mothers youngest Brother and I don't know where he is buried. It was found as proof that Margaret Pierce(Pearce)'s husband was Richard. Dawn said she will get further records to see if we can find anything else further back. I have been the one to follow Sion and document all of that. When I reviewed all the records I collected that is where I found the information that Sion Taylor was of Richard Taylor. TAYLOR's father is. I found a divorce paper of Sion and Dianna (MILLER) TAYLOR and on it it stated that Sion TAYLOR of Richard TAYLOR which means that Richard was his father. I knew that Margaret was their mother, but didn't have records on the father. Just spoke to Dawn Peters yesterday and told her of this new finding. My sister and I had taken trips to Hawkins, Carter and Roane County in search of Sion Taylor and his Descendant. If you look in 1860 census you see that brothers Sion and John R TAYLOR live next door to each other. If you look back further to Carter County census of 1850 you will see both living with mother Margaret TAYLOR. John R.'s female children are named after Sion's wife's Amanda Jane and Dianna. I'm sure since I gave the information to Dawn she in her infiinity of wisdom will be able to find more.
