Members of this list should be aware of the attitude of Shelbyville, TN City Officials and Developers regarding cemeteries in Bedford County. Those of you with interest in Cemeteries in this or any other area should be aware. Currently developers have asked to have property, including the McCuistion Family Cemetery adjacent to 201 Old Nashville Dirt Road in Shelbyville, TN, rezoned to residential for the purpose of building modular homes. Property surrounding the cemetery has been fenced and a herd of cattle is being pastured there. These cattle are destroying old tombstones and signs of graves. Developers, James W. Warren and Donald Stephenson, have refused to fence and preserve the cemetery; eventhough, they agreed to do so, in writing in 2001. City manager Ed Craig, Mayor Geneva Smith, Codes Enforcement Officer Wayne Williams and Chief of Police A. Swing have been contact without response. Mr. Fielder from the State of TN archaeological Office has also been contacted. The McCuistion Cemetery contains 36+ graves, most notably that of Ann Moody McCuistion, wife of Thomas McCuistion. Ann was the Grand Aunt of President Andrew Jackson. Ann was a participant in the battle of Guilford Courthouse in Greensboro, NC prior to coming to TN. Ann & Thomas McCuistion's home was seized by General Cornwalis and used as his headquarters during the battle of Guilford Courthouse. Approximately 2000 acres of downtown Shelbyville, TN was originally owned by the McCuistion family. A grist mill owned by Thomas McCuistion and Andrew Jackson was located on Duck Creek, near the cemetery, in Shelbyville. This cemetery is listed with the "Saving Graves Organization" as an endangered Cemetery. Title 46 of Tennesse Codes enumerates laws pertaining to preservation and destruction of cemeteries. These laws may be found "on Line" on the State of Tennessee Web Page. Destruction of Cemeteries is clearly a Felony Criminal Offense by Tennesse Law.
