I have transcribed the index to the Circuit Court Minutes 1840 - 1851. Note that this index includes only names that occur in the styles of cases, not every name in the minutes. This index is now posted at http://www.gscassociates.com/indices/CCC_1840_index.htm and will eventually be posted on the Bedford TN GenWeb pages also. This index had not yet been proofread.
I want to post an example from my own research on my 4GGF John F. Thompson Sr. that illustrates how incomplete the present indices to Circuit Court records are. Thompson and others, exparte petition for division of slaves Be it remembered that this cause came on again to be heard before the Honorable H. L. Davidson, Judge. And it appearing to the satisfaction of the court that sends the last term of this court that Emily Earnhart one of the petitioner says intermarried with one Thomas Baxter and that it is more proper to divide and alot the slaves between the said Emily and her said husband and the said Henry Earnhart, which was ordered by the decree of this court at the last term to be divided, and on motion of the said Thomas Baxter and Emily about their counsel it is ordered that Graden H. Stewart, Garrett Phillips, and Alex Sanders be appointed and directed in addition to their duties directed by the decree of the last term be directed to divide and alot to the said Thomas Baxter, Emily his wife one share in Henry Earnhart one share and that they report their actions to the present term of the court. I have often used Chancery and County Court records in my research but until recently had not ventured into Circuit Court records. I have been reading through the early Circuit Court Records of Bedford County that begin in 1840. They contain a wealth of information that I have posted examples of at: http://www.gscassociates.com/CCC_examples.html Here is a list of the early volumes. The TSLA microfilm roll number and name is listed first, with the individual volumes on that roll listed indented under that. I have noted the total number of pages and whether or not the volume contains an index to cases. None of the volumes has an "every name" index. Once work currently underway to finish transcribing (or creating) indices to the County and Chancery Court records is finished, it would be very useful to get at least the case indices that are in these volumes transcribed. I have been at a brick wall trying to determine the parents of my gggrandmother Martha C. Pickle. She is on the 1850 census living in the household of Jonathan Leggitt. Jonathan's wife Penelope is the daughter of Henry Pickle & Rachel Neely, so we can assume Martha is related to Penelope in some way. Two of Penelope (Nellie) Pickle Leggitt's brothers, John and James, are old enough to be the father of Martha. None of the family trees posted on ancestry have Martha listed as a child of either of them. Each tree for John lists 10 children: Sarah, Nancy, John H., Newton, Thomas, William, Richard, Rachel, James, and Emily J. (one left out Thomas, but perhaps it was simply an oversight) The 1850 census for John Pickle (spelled Pickel). His household lists John Pickel, Sarah, John N., Joseph, Thomas, William, Richard, Rachel, James, and Emily J. The 1860 census shows John Pickle has moved to Marshall county. His household lists John Pickle, Sarah, Wm, James, Milly J., Robt, Jacob, Major, and Meredith P G. The 1870 census shows Sarah Pickle in Township 13 Range 5, Pope, Illinois. (Martha Pickle, now married to William Marshall, is also living in Illinois, close to Joseph & Emeline Pickle, so the Illinois location doesn't seem odd.) The household lists Sarah Pickle, Jacob R, Major H, Menditty, and Elizabeth, all born in Tenn. The 1840 census lists John Pickle as the head of a household in Bedford County. His household includes 3 males under the age of 5, 3 males ages 5-under 10, 1 male age 30-40, 1 female under the age of 5, 2 females ages 10-15, and one female age 30-40. OK, now the questions: In the 1840 census, John must be the male age 30-40, and his wife must be the female age 30-40. I thought Sarah and Nancy would be the daughters 10-15, and my Martha (remember her?!) could be the daughter age 5-10. (Martha was born 1832, and would have been 8 on this census). The 3 males under 5 could include William and Thomas, and the 3 in the 5-10 group could include John H, and Newton. If Joseph was in the younger group, the one in the older group could have been on his own by 1850. If Joseph was in the older group, the younger one might have died. If Sarah is John's daughter, then there is no wife on the 1850 census. So where'd the younger children on the 1860 census come from? Did John's wife AND an older daughter die before 1850? Is Sarah his 2nd, much younger, wife? Why aren't any of the children after Emily listed on anyone's Pickle family tree? (None of the trees list the name of John's wife, nor do they indicate more than one marriage.) I am open to any suggestions on where to proceed from here. I am specifically looking to find out information about a T Oliver Ferguson who signed a petition concerning the Bedford/Rutherford Co border in 1823. My great grandmother was a Ferguson her name was Elizabeth Jane Ferguson born April 19, 1839 TN. it is said she was born in Rutford but I don't have her birthday certificate just her death certificate and it only states TN. but doing checking onn her Ferguson line her father was James Ferguson and they were in TN. not sure if related to yours are not as I don't recknize the name sorry. I'm going to post a series of early deeds and surveys related to the Halls and some "associated" families. These are mostly prior to 1840 and focus on families who settled on: 1) "Caney Spring" (or, today just "Spring") Creek in what is now Marshall County. 2) near where Weakley's Creek joins the North Fork in Bedford County. I have been helping collect data on these families and the records may be useful to other researchers, so I am posting them all to the list. If you are researching any of these families, and especially the branches of the families who moved on to MO in the 1820s and 1830s please post back to the list. The records I will post are a mixture of abstracts and transcriptions. Some spill over into parts of Williamson, Rutherford, Warren, and other counties that bordered Bedford at the times the deeds and surveys were made. Steve
