    3. Trooper Frederick J. Sutton, Pennsylvania State Motor Police Trooper Frederick J. Sutton was killed by Brice Hann Sr., age 54 on Wednesday evening January 3, 1940. Trooper Sutton had a warrant of arrest for Hann, a widower and laborer from R. D. #1 McConnellsburg, PA., issued by W. H. Greathead, Justice of the Peace, on a complaint from Lester Gress that Hann had issued a worthless check to Gress for fifty dollars ($50.00) on December 14, 1939. Trooper Sutton tracked Hann down just outside the "West End Restaurant" in the Borough of McConnellsburg on the evening of January 3rd. Trooper Sutton attempted to serve the warrant and placed his hand on Hann's shoulder and started to run it down the outside of his arm in an attempt to move Hann along. Hann, carrying a .32 caliber pistol in his pocket, shot Trooper Sutton causing his death. An "information" was filed by Trooper Martin J. Walsh, Pennsylvania Motor police, on January 6, 1940 charging Hann with the murder of Trooper Sutton. On March 15, 1940 a "True Bill" was returned by the Grand Jury with an indictment of murder. A trail by jury started on March 18, 1940 in the Fulton County Courthouse, the Honorable Judge W. Clarence Sheely, presiding. On March 22, 1940 the jury returned a verdict of "NOT GUILTY", Earl M. Akers, foreman. Frederick Sutton Memorial Lodge was granted it's charter on March 29, 1949 and so named in memory of Trooper Sutton and the ultimate sacrifice he made for the citizens of the Commonwealth of Pennsylvania.
