Jan. 1874 Robert F. Fleming, administrator of the Estate of Ezekiel T. Stout, Deceased vs. Calvin Heather and Elijah Heater, In Debt This day came the parties by their attornies, and neither party requiring a jury, the whole matter of law and fact was submitted to the court, and the evidence and argument of counsel being fully heard, the court is of opinion and doth find for the defendants. It is therefore considered(?) that the plaintiff take nothing by his bill but for his false claims be ---- -- and that the Defendants receive against the plaintiffs their costs by them about their defense in this behalf expended, to be levied of the goods and chattles of the decedent in his ---- to the administrator. (Order Book 1874-1877), dated Jan. 1874. 10 Feb 1874 Jasper Norman(?) vs. Nathan Stout In Debt On motion of the plaintiff by his attorney he has leave to amend his declaration which is ---- done in court. (Order Book 1874-1877, dated Feb. 10, 1874.) 12 Mar 1874 In the Clerks Office of the County Court of Gilmer Couny before the clerk thereof on this 12th day of March 1874. On motion of Rebecca Marks and it appearing to the clerk that more than three months have elapsed since the death of John Marks late of the County of Gilmer, and that Adminsitration of his estate has not been granted to any person, It is therefore ordered that the Sheriff of this County take into his possession the personal estate of the said John Marks deceased and administer the same according to law. And the Clerk doth appoint Johnathan N. Busk, Philip Rutherford and William Scheiffio(?) appraisers, who are directed to appraise the personal estate of said John Marks, deceased, according to law and make return thereof to a future term of the County Court of said County.
