Plaintiff: Mary A FERGUSON Defendant: Daniel T FERGUSON Date: 20 Nov 1897 File: 279 This case is even longer than the previous thus I will be abstracting heavily, but including all names and pertinent information. Couple was married in Monroe Co 17 May 1897; both have resided in the state continuously. Defendant in a fit of anger has repeatedly Plaintiff with great bodily harm and threatened to drive her from her home; has failed to provide her and her children from securing necessary items except by selling her own personal property. Usual statements used saying "cruel and inhumane treatment", etc. She also asked for alimony and payment of her attorney's fee. Deposition begin. Chas. VIBBERT, Superintendent's office in Tompkinsville 30 Sep 1898 (so written, would be 1897). 44 years old, lived in the county, a blacksmith, knew the parties.The Plaintiff is a sister of his wife. Mentioned visiting them, the children. He though Deft. was providing for Plaintiff. Did see one racket due to the child fretting and the "old man" kindly asked her to attend to it. She kept child quiet from 9-11 pm; the old man scolded the child several times; would slap him if he didn't quit; old man got out of bed and slapped the child harder than Vibbert thought he should. The Plaintiff got out of bed and tried to take the child out of his arms; might have hit her. He pushed his wife back by putting hands near her breast and neck. Plaintiff threatened to hit him Deft with a poker; Deft responded with profanity. Wife threatened not to sleep in the same bed with Deft. Question to Vibbert: "Did you know anything about the Plaintiff having abandoned one or her former husbands. He answered that it had been reported that they were separated. She had been married 3 times and had three children with her at old man Ferguson's - 2 of them were about 6 and 8 and one was 2 or 3. Ended by saying that Ferguson's reputation was not very good in the neighborhood. Many more questions then were asked about if she cooked for him, how often the Deft was absent. Under cross-examination said the child that was slapped or whipped was the 2-3 year old. Lived 2 miles from the family. Deposition of John S BUSHONG, same time and place. Age 18, lived Monroe Co, farmer, knew parties. Had heard a conversation between James Emberton and Bud FERGUSON at Bud's crib when they were discussin't shared a bed for three weeks; hadn't seen any abuse other than the slapping/whipping.
