Plaintiff: Nancy T. Gerald Defendant: James Henderson Gerald Date: 25 Aug 1895 File No. 377 This is another lengthy case where Nancy is filing for divorce against James. It is stated that they were married in Monroe County in 1854; both still live in the county. Nancy stated that they lived together until the month the case filed and that James forced her to leave their home by force and violence. He supposedly beat and bruised her; had an outrageous temper which was a probably danger to her life and great bodily injury. Remember - there was standard wording in all these divorce cases to make it look as bad as possible! Nancy said that she had always treated him in a kind and affectionate manner, was faithful and true to him. During their married life was born to them 12 children; five now living and all over 21 years old who live separate from them. She stated that he made no provision for her, she has no estate of her own and she is entitled to an allowance, alimony and maintenance for herself out of James' estate. He has ample means to provide for her; he owns a tract of land in Monroe Co. The land is worth about $600. James also owns two houses, six sheep, one hog, one cow, one crop of corn & oats on this land. She is afraid that James will try to sell all this or conceal it. An injunction has been asked for but the Judge of the Monroe Circuit Court and the Judge of the Court are absent from Monroe Co. She asks the Clerk of this Court or Judge for an order injoining and restraining James from selling, conveying, concealing or disposing of the property. She prays for a divorce, maintenance, alimony, her property restored owned by her before their marriage and for costs. James says it is true they married. Denies violence and her being coerced and that she left their home because he forced her to. He denied having a outrageous temper, etc. He denies that she was kind and affectionate towards him and that she was faithful to him. He denies ever beating or bruising her or forcing her to leave without provisions; denies that she deserves alimony, etc. James said he owned about 150 acres of poor land worth about $400; said Nancy has no vested interest in it. Denies that he owns houses or personal property Nancy named. He is not planning on conveying, hiding, etc. anything. No injunction should have been ordered by Nancy. James stated that he was over 71 years old, almost deaf, has nearly lost his mind, is physically very weak and infirm; unable to do manual labor more than a few chores. Nancy is only 59 years old, in fairly good health and well preserved for a woman her age. He charges that she and their children have all turned against him. He is on the verge of being wholly dependent on someone to care for him - and none of his children or wife want to do this. He's worked hard all his life, tried to live a Christian life; raised 5 children to be nice teachers and highly respected. Their son Gerald is a practicing lawyer in Glasgow. He owns the property and has agreed with Nancy a number of times - once signed writings agreeing that a disinterested person should divide the property real and personal equally between them. At the time that Nancy abandoned him they had 15 bed blankets - all have disappeared but 3. They also had 30 piler (pillow) cases - all gone but 2. Many of the quilts have disappeared and one bed plus several other things. James said he has tried to get Nancy to remain at home with him but instead she brought this suit. He has no desire to treat her poorly. He asks the Court to make a division of his property between them. Wherefore James prays for the injunction to be dismissed, Nancy's petition dismissed and the costs. Sworn to before J. H. Gerald on October 11, 1895. And ... no resolution in the file packet! And ... no resolution in the file packet! Randy Jobe - do you know what happened next? Kinda confusing...This is actually John Henderson Geralds...his wife, Nancy Thomas Greenup. Yes, he was old and infirm because he died less than a year after the filing. Nancy died in 1933 at the age of 98. I don't know the outcome, but the point would be moot at his death.
