    3. I have always had a question on these proceedings. Instead of seating one jury for the day; it appears that different juries were called for different cases during one day's session. Also, you might note that sometimes someone on the jury actually had a case against or for them pending! Next week a short break and I am going to give you some definitions of the terms used - might help you figure some of these cases out! Sandi On Wednesday, 6 Feb 1799 the court was called to order with Burwell JACKSON and John SHANNON, Esquires, present. Commonwealth vs JACKSON - upon an attachment. Hezekiah JACKSON by his attorney ordered that the indictment be granted & the prisoner discharged from further prosecution. The following cases were handled: HAMMETT vs DICKERSON - Write of Inquiry set aside and case continued. Robert HERRILL vs McPHERSON, COLLINS vs STUART; LATHAM vs JACKSON; ASHBY vs BOONE and ANDERSON cs HUDSPETH - all of these were continued. Justice John HALL joined the other Justices. Commonwealth vs NEAL. The defendant came forward into court and pled not guilty. A jury was called: Geo MOORE, Valentine DICKERSON, Will ROGERS, Isaac CRAWFORD, Daniel GUST (Gist?), John MARSHALL, James CAMPBELL, John COOK, Patrick McCUTCHAM, Charles EADS, John NEARKEN?, Samuel GOODE. They retired and came back with a verdict of not guilty. The following cases were heard and continued: CALDWELL vs MADISON; THOMAS vs KREEK; WYATT (assignee) vs WALKER; HAMMONDS vs SUGGS, SUGGS vs BARTLETT etal and ISAACS vs BARTLETT (this case continued until June so depositions could be taken). Commonwealth vs BOONE; grand jury called: Geo MORE, Valentine DICKERSON, Will ROGERS, Isaac CRAWFORD, Daniel GUST, James CAMPBELL, John COOK, John MARKER, Samuel GOODE, George FRAYZER, Will MORIX? and James LEWIS. Verdict found for the defendant. WILLIAMS vs LYNN - attachment dismissed. HERRILL vs McPHERSON - depositions to be taken with 10 days notice. HAMMETT vs DICKERSON - Dismissed by each party paying his own costs. HAINS vs BILIU?. Jury seated: Robert WALLACE, Samuel THOMPSON, Henry GORIN, John ESTIS, Will MITCHELL,Elishor? STRACHEIN?, Geo MARTIN, John BILIU, Will HAMMET(T), James BELL, Keln KUCK (Killian Kreek see note below), & James LEWIS. Verdict returned for 7 pounds . BELL vs CLAYTON - depositions to be taken. THOMAS vs KREEK - writ of inquiry set aside and plea of payment, cause continued. Court adjourned until the next scheduled court. Note: Killian KREEK, also spelled Killion CREEK is the man who built the mill on Beaver Creek in Barren County. He was from PA and was a stone mason. This mill still stands.
