This is a very long case and I will be doing a lot of abstracting but include the pertinent information. This will run more than one week. Plaintiff: C. E. England Defendant: James G & T L England Date: 24 Apr 1891 File No. 153 C E England stated that she and James G England were married in Monroe Co about 18 yrs ago; they have since lived in the same county and are now citizens there. They set up to keeping house and to work to make a living; living together as man and wife for a number of years peaceably and happy. But she says her husband (defendant) became cross and fractious with her about 5 years past and for the last 12 months rendered her peace and happiness miserable. His conduct towards her was cruel and inhuman; settled aversion against her, etc. His conduct towards her is not justifiable or excusable on his part. She never gave him any offense or come to distrust her as his wife. She behaved herself but his conduct became such that he has compelled her to leave & abandon him on or about 14 Mar 1891. They had 3 children who she has with her and they look to her for maintenance & support, none because of their age unable to support themselves. She has but little property when she left him & her husband sold and disposed of it in order to prevent him from holding it. He is now trying to sell & dispose of the rest of their property to cheat & defraud her and the children. She charges that T. L. England who is her husband's brother has in his possession their milch cow, 7 yrs old and 2 yearling calves (described) to cheat her. She believes her husband is about ready to move out of KY and sell all the rest of the property unless prevented by the Court. She asks for the necessary orders to stop him and to obtain alimony. She prays for a divorce & alimony. Her attorneys were J. A. Scott and J. R. Leslie. The depositions begin. William Copass, Clerk's office of Monroe Circuit Court, 22 June 1891: 18 yrs old, resides Barren Co; farmer; knew the parties. Had been at the England's home while they were living together several times. Was there about the last of Jan or first of Feb 1891. She started to go to the meeting; he told her she wouldn't; she told him she wanted to go; he said if she went she would not stay with him any longer. She went to the meeting; he told her to get her things or if she didn't he would throw them outdoors and would thrash her. I and her son went on out into the woods a piece from the house but I'd left a 1/2 pint of medicine I'd forgotten & left at the house. I went back and the defendant swore that he was as good as his word. He showed me the bed and said when you overtake her again tell her to come back and get her things or he would stick the &*&*&* things in the stove and burn them up. When questioned Copass said that it was ill treatment. Why didn't he want her to go to the meeting? She had claimed sanctification - he said drop it or he would not live with her. Copass had never heard the defendant say he would kill her. They had 3 children; he supposed the mother has them. The parties had some property, a cow & 2 yearlings; some h hogs and some corn; kitchen and household furniture. What happened to the property? J. G. England said it was mortgaged to Tobe England - the T. L. England of this suit. Copass was cross-examined by the Defendant's attorney. He asked if anyone had talked to him about this case and he replied one of the Davis boys had asked him about the case. Mrs. Leslie was talking about it this morning. J. A. Scott, one of the plaintiff's attorneys and her brother, Uncle John Trevatt. Copass said that the plaintiff was his aunt. He was questioned again about the conduct of both parties, it looked like rain the night he was there. Defendant had told her that if she went to the meeting he would wear her out and if she went she wouldn't stay there with him any more. To be continued next week.
