We're continuing the trial of Frank Laswell charged with the murder of George Seaver. On 14 April 1888 more summons were issued. Called were: C. T. BEVELL, Nehemiah DARTER, Mike WINIGER (WININGER), Bland READ, Emmitt WILLIAMS, J W CARDIN, J T MARTIN, Geo T DUFF, Henry COOMBS, J P NUCKOLS, E MORRIS, Jno MURRAY, Wm McQUOWN, Jas C EVANS, Jas B MARTIN, Tom CARTER. On 6 June 1888, the Sheriff was calling on: W L PORTER, Will COLLINS, Henry TAYLOR, W PAGE, C T CHEEK, J S LEACH, Jas M RICHARDSON, C A HAMILTON, A RAPP, Tom LEACH, W R PEDIGO, Tom BARTER (BAXTER?), Ed WILLIAMS, Prof ELROD, Mrs ELROD, CY MURPHEY, Mrs MURPHEY, Jos CHURCH, John CHERRY, W J BRADFORD and Felix BRADFORD. Again, on 23 Aug 1888 - E W & Mrs. ELROD, Buford McCOWAN, Thos PRITCHARD, Bland READ. On 2 Sept 1888 - Dr. S T PURCELL, W H PACE, H BEVILL, Col. BEVILL, N DARTER, Mike WINIGER (WININGER), Wm Mc___, John A MURRAY, Jas HARTNITT, Jim SMITH, Jas E EVANS, B F TRABUE, Jno RITTER, A G DRANE, Jno LAY, J P NUCKOLS, J F PRICE and H M PEDIGO. Finally on 18 Sept 1888 - The Sheriff of Whitley Co was ordered to summmons T R MINER. Now for some details. On 18 Sept 1888 in the Commonwealth vs Frank Laswell on Indictment for Murder. The defendant on his own said he is not ready for trial on the account of the absence of James C. EVANS, W C PACE and Frank PRICE all of whom have been summoned but are not in attendance or not absent by consent . By Evans he can prove that the act was a violent blasphemy (?) and that Seaver was a dangerous man - revengeful in his misfortune and that he usually went armed. By W C PACE he can prove that he told affiant of a treat with Seaver had made against the officer to take his life with a double barreled shot gun a day or two before he was killed. By Frank PRICE he can prove same as by Evans. That Seaver was usually intoxicated in the better part of his life. By all three he can prove his temper & misfortune and that they knew him. The witnesses will make the above statements ... PACE is sick and confined to his room and unable to come to court and testify at this time. Next week, testimonies and conclusion.
