This Indenture made and entered into this __ day of March 1880 between Joseph R. GARNETT and Lucinda C. Garrett, his wife of the first part and Samuel H. Jenkins of the Second part witnesseth that for and in consideration of the Sum of Three Thousand Dollars in hand paid the Receipt of which is hereby acknowledged, the parties of the first part have this Day and by their presents do convey unto said party of the Second part the following described Towit: a parcell of land Lying and being in the County of Ballard Kentucky it being the Tract of land Conveyed to H. E. BLACK, a Commissioner appointed by an order of the Ballard Circuit Court in an action in said court in which the parties of the first part were plaintiffs and Z. ELLIOTT and others were Defendants, To said Garnett & wife Known as a part of the William CLARK survey, which deed was Recorded in the Ballard County Court clerk's office, Now Burned, which Tract or parcel of land in Ballard is as follows ... gives metes and bounds, no names shown ... To have and to hold unto the Second prt his heirs & assigns forever. And the parties of the first part covenants and agree to forever warrant and Defend the Title to the land herein Conveyed against the Claims of all persons whatsoever, and the said Lucinda C. Garnett hereby Conveys & relinquishes unto the party of the second part her right of Inheritance in & To the Tract of land herein conveyed. In Testimony whereof the parties of the first part have hereunto set their hands & Seals this Day & Date above written. This Deed is made in Lieu of an ex___ to S. H. Jenkins by the parties of the first part in 1870 & for the consideration above ___ in this Deed.
