Great men are only great in their methods. They simply draw their plans on a larger scale think is in bigger units trudge to further horizons climb longer hills contest in greater arenas and accept no compromise from opportunity. It is the size of the game as well as the size of the man that spells success. Persistency and a fixed determination to forge ahead has characterized the business career of James B. Harvey, and those qualities have enabled him to make of success not an accident but a logical result. He is now extensively engaged in the lumber, milling and real-estate business at Marrowbone, in Cumberland county, Kentucky, and it was he who organized the Cumberland River Lumber Company, in which he is a heavy stockholder and the present treasurer. James Bryson Harvey was born near Summershade[sic, Summer Shade], Metcalfe county, Kentucky, on the 5th of October, 1853, and he is a son of Calvin Clinton Harvey, who was born and reared in Barren county, Kentucky. The father was identified with agricultural operations during the major portion of his active career and he twice represented Metcalfe county, Kentucky, in the state legislature. He married Miss Nancy Jane Wade, of Barren county, and they became the parents of three children, - Prentice W., who is now deceased; James B., who is the immediate subject of this review; and Sanford S., who is identified with the mercantile business at Willow Shade, Kentucky. Calvin C. Harvey was summoned to the life eternal on the 3d of March, 1909, and his cherished and devoted wife is now living at Marrowbone, Kentucky. The paternal grandfather of him to whom this sketch is dedicated was a native of Virginia, whence he immigrated to Kentucky about the year 1820. Under the sturdy and invigorating influences of the old homestead farm James B. Harvey was reared to maturity and his practical education was gained in the common schools of Metcalfe county. He remained at home and assisted his father in the work and management of the old farm until he had reached his twenty-fifth year and he then became interested in the active affairs of life as a lumberman. For a number of years past he has been in the lumber, milling and real-estate business at Marrowbone, Cumberland county, Kentucky, in which prosperous little city he has maintained his home since 1899. He was largely instrumental in the organization of the Cumberland River Lumber Company, which was incorporated under the laws of the state in 1909, with a capital stock of twenty thousand dollars. Of this flourishing concern E. G. Alexander is president; C. C. Harvey, vice-president; and Mr. Harvey, secretary and treasurer. He is a business man of keen perceptions and extraordinary executive ability and in view of the fact that he is strictly self-made his fine success in life is the more gratifying to contemplate. On the 8th of March, 1877, was recorded the marriage of Mr. Harvey to Miss Elizabeth Taylor Watson, who is a daughter of Dr. Lindsay Watson, a prominent practicing physician and surgeon of Metcalfe county. Mrs. Harveys mother was Parthenia Larrimore in her girlhood days. Concerning the children born to Mr. and Mrs. Harvey the following brief date are here incorporated, - Parthenia Watts is the wife of rev. R. B. Gruder, a Methodist minister at Elkton, Kentucky; Flora Jane, who is now Mrs. Charles H. Shannon, of Marrowbone, and Curtis Clinton, who manages his fathers lumber yard at Glasgow, Kentucky. In his political convictions, Mr. Harvey has ever recorded a stalwart allegiance to the principles and policies for which the Republican party stands sponsor, and, while he has often been requested to run for public office, including that of senator, he has never shown aught of desire for political preferment of any description. At one time he gave efficient service as surveyor of Metcalfe county, to which office he was appointed in 1887. He is very prominent in financial and business circles and is everywhere admired and respected for his fair and honorable methods. In his religious faith he is a consistent member of the Presbyterian church, to whose charities and benevolences he is a most liberal contributor. Some of these terms will be very familiar; some you might want to print off for the next time you run into them in the old documents. Change of Venue: This was the same as it is today, asking for another place for a court trial to be held because of the inability to get a fair trial in the location where the event occurred. Chattels: Articles of personal property. Collateral heir: One who receives property from a relative other than a direct relative. Such as a niece from her uncle, etc. Direct heirs would be cousins, brothers, aunts, uncles, etc. Consort: Spoken of women primarily; husband is still living at the time of the woman's death. Common law: General and ordinary law of a country or community. Not as common law marriage. Corporeal: Tangible. DeBene Esse: Done conditionally. Defendant: The one being sued in a legal action. Demise: To convey an estate for years of life not meaning the death of a person. Demurer: A denial by the defendant that the allegations of the declaration, even if true, would legally constitute a cause of action. Deposition: An affidavit. In many of the cases I've shown, the witnesses did not physically appear in court before a Judge. They gave their testimony or depositions before someone appointed by the Court in another location. These depositions were then written out, testified to by the individual appointed and presented to the Judge. Detinue: A common law action used to recover personal items wrongfully held by a person whose original holding was unlawful. Again, thinking of some of the cases I've shown, the defendant was charged with defrauding a spouse or someone and was supposedly going to leave the territory and take things with him that either didn't belong to him or would cause great hardship on the other party. This law of Detinue was issued to prevent the person from doing this. Distribution: Spoken of estates. Debts & costs have been settled after the death of an individual and the remainder could then be distributed to the legal heirs named. To be continued next week. Plaintiff: Sarah Ferguson Defendant: R. G. Ferguson Date: 11 May 1899 File No. 279 Another divorce case. Parties married in KY in 1895; both reside Monroe Co. They lived together until 1896 (month and day not shown) when defendant deserted her though she had always treated him a kind and affectionate manner. She prays for a divorce and to be restored to her maiden name of Sarah TUDOR. J C CARTER was her attorney. Depositions taken: James L. Ferguson, taken at Rock Bridge in Monroe Co on 31 Jan 1900. 34 years old, lives Monroe Co, knew both parties. Stated the couple were married in Barren Co in 1895, lived in Monroe Co. Lived together 4 years but "they did not live together but about six months before defendant left her. He had visited them while they lived together; she treated him well; he abandoned her through no fault of hers. Tom Ferguson taken same time and place. 26 years old, lives Monroe Co, knows the parties. Same statements as above. The cause came on and was submitted for trial and Judgment upon the petition and proof at the Court was sufficiently advised. It is the opinion that the Plaintiff, Sarah Ferguson, is entitled to the relief sought in her petition . It it therefore adjudged of the Court that Sarah Ferguson be divorced from the defendant R. G. Ferguson and that she be restored to her former name Sarah Tudor. It is further ordered and adjudged that the defendant, R. G. Ferguson pay all costs expended by the plaintiff in bringing including $25. for attorney's fees. Cause is stricken from the docket. Instead of a post on the Warren Co Court of Quarter Sessions this morning, I'm taking a week or two to give you some legal definitions that you, as a researcher, will likely run into. Most of these mean the same thing today as they did in the early settlement days; some might have changed its meaning somewhat. I'm sending to both of the lists.To understand the old wills, deeds and court cases, you need to know what these words mean! Ab intestate: Normally just shown intestate, this means someone who has died without leaving a will. Acquittal: Found not guilty and set free. Ad damnum: An individual's statement who brings a case into court, or the monetary loss/damage asked in a suit. Ademption: Normally, a bequest taken away from a will. Adjudication: Any decision made without explanation of the degree of guilt. Ad Litem: For the duration of. This is normally seen for an infant who had a guardian appointed for them when the parents were still living. For some reason, the parents could not or would not represent the child and his/her rights so they appointed a guardian ad litem - for the duration of the trial or case. This individual spoke in behalf of the child to be sure the child received what was due him. Researchers will find this term used in many instances, especially when, in a will, an infant was given land, slaves or property. Guardianship lasted until the child was of age in contrast to someone appointed ad litem who would represent the child for a short time. They were also referenced as "best friend." Even adults could have someone appointed - single women, the elderly, or anyone who could not do it themselves. They may or may not be an attorney. Administrator: This is an individual appointed by the probate court to administer the estate of one dying intestate. He paid the bills the deceased left, collected money due the estate. If a female was appointed she was called an Administratrix. Ad quad/quod damnum. This was a writ asking what the loss or injury would be. Researchers will see this when a settler was planning on erecting a grist mill. A "jury" of men went on the land and estimated what damage would result to neighbor's property from any water which may overflow. If damage could be caused, either the settler would not be allowed to erect the mill or would have to pay for possible damages. Appellant: One who files an appeal. Appellee: One against whom a cause is appealed. Assault & Battery: We heard this term frequently. Assault is the attempt to strike. Battery is the actual strike. Assignee: The purchaser of property. If Jones was the assignee of Smith, Jones bought from Smith. At Bar: Before the court. Attachment: Taking of persons or property into legal custody by virtue of a writ, summons or other judicial order. In many early court cases one will see this term. If someone was ready to flee the county (as in a divorce), an order of attachment could be issued to keep him from removing property until the case was settled. Or, if someone had not paid his debts or taxes, his property could be attached and sold to pay off the debt. Bar sinister: illegitimate. Battery: Touching another person, even if gently, without his/her approval. Bed & bedstead. this is found in wills and inventories of estates. This was a cover made of feathers which is used on a bed. Bondsman: a surety or security who pledged a sum of money as bond for another. Many cases required a bondsman or bondsmen. They were required in posting a marriage bond (intent to marry), in criminal and civil cases, in governmental offices (attorneys, County Clerks, etc.). Carnifex: the hangman or executioner. Case: Law suit Cause: an action or suit Chancery: equity - not criminal. To be continued. Yes, they were divorced and Daniel remarried in 1899. Mary Ann never remarried. Daniel died in 1900 and Mary Ann in 1943...both buried at Slagg's Creek Cemetery. I have always had a question on these proceedings. Instead of seating one jury for the day; it appears that different juries were called for different cases during one day's session. Also, you might note that sometimes someone on the jury actually had a case against or for them pending! Next week a short break and I am going to give you some definitions of the terms used - might help you figure some of these cases out! Sandi On Wednesday, 6 Feb 1799 the court was called to order with Burwell JACKSON and John SHANNON, Esquires, present. Commonwealth vs JACKSON - upon an attachment. Hezekiah JACKSON by his attorney ordered that the indictment be granted & the prisoner discharged from further prosecution. The following cases were handled: HAMMETT vs DICKERSON - Write of Inquiry set aside and case continued. Robert HERRILL vs McPHERSON, COLLINS vs STUART; LATHAM vs JACKSON; ASHBY vs BOONE and ANDERSON cs HUDSPETH - all of these were continued. Justice John HALL joined the other Justices. Commonwealth vs NEAL. The defendant came forward into court and pled not guilty. A jury was called: Geo MOORE, Valentine DICKERSON, Will ROGERS, Isaac CRAWFORD, Daniel GUST (Gist?), John MARSHALL, James CAMPBELL, John COOK, Patrick McCUTCHAM, Charles EADS, John NEARKEN?, Samuel GOODE. They retired and came back with a verdict of not guilty. The following cases were heard and continued: CALDWELL vs MADISON; THOMAS vs KREEK; WYATT (assignee) vs WALKER; HAMMONDS vs SUGGS, SUGGS vs BARTLETT etal and ISAACS vs BARTLETT (this case continued until June so depositions could be taken). Commonwealth vs BOONE; grand jury called: Geo MORE, Valentine DICKERSON, Will ROGERS, Isaac CRAWFORD, Daniel GUST, James CAMPBELL, John COOK, John MARKER, Samuel GOODE, George FRAYZER, Will MORIX? and James LEWIS. Verdict found for the defendant. WILLIAMS vs LYNN - attachment dismissed. HERRILL vs McPHERSON - depositions to be taken with 10 days notice. HAMMETT vs DICKERSON - Dismissed by each party paying his own costs. HAINS vs BILIU?. Jury seated: Robert WALLACE, Samuel THOMPSON, Henry GORIN, John ESTIS, Will MITCHELL,Elishor? STRACHEIN?, Geo MARTIN, John BILIU, Will HAMMET(T), James BELL, Keln KUCK (Killian Kreek see note below), & James LEWIS. Verdict returned for 7 pounds . BELL vs CLAYTON - depositions to be taken. THOMAS vs KREEK - writ of inquiry set aside and plea of payment, cause continued. Court adjourned until the next scheduled court. Note: Killian KREEK, also spelled Killion CREEK is the man who built the mill on Beaver Creek in Barren County. He was from PA and was a stone mason. This mill still stands. Unless all the stones are missing of Daniel and his wife - that's not it. The photo shows 4 stones; his, his wife's and 2 which are not readable, one might be a footstone. I checked the Trigg cemetery too.... again not shown. I have a feeling that the cemetery is now overgrown and not found or the stones down and covered. Thanks so much Mike ... Does anyone know the location of the Daniel Curd cemetery in Barren County? Daniel, our first county surveyor, was born 14 Oct 1774 and died 18 Apr 1843 in Glasgow/Barren Co. His wife was Fannie Saunders Trigg on 18 Mar 1801 in Barren County. I have a 100-yr old picture of the cemetery but the location is unknown. Can anyone help?
