    3. Plaintiff: F. P. Hood Defendant: Louisa J. Hood Date: 5 Aug 1889 File: 113 A longer case, abstracted. Plaintiff said they were married in Monroe Co 24 Nov 1885, have lived together until July 1887 - about two years ago. They separated and haven't lived together since. He charges that she abandoned his bed and refused to bed with him; not reciprocated. He provided a good home for her and all the necessities of life ... He had lived in Monroe Co about 36 years or all his life. Prays for a divorce. Attorney was J. A. SCOTT. Depositions taken: William T HOOD, taken 17 Oct 1889 at Mud Lick, KY in office of J. B. EUBANK. 18 years old, lived Monroe Co, farmer. Had known the parties 12 years and knew them to be husband and wife. Had heard her use harsh language to him. One day Plaintiff went off to the mill and failed to get back by dinner time. She wouldn't get him any dinner because he was late; he had no business staying away as long as he did. He had to wait in line for the grinding making him late. Deponent heard her say she would never give him a divorce but she didn't intend to live with him anymore and would seem him dead da....ed and in a hill before she would live with him. Never saw plaintiff mistreat her. Eliza J. TURNER, taken same time and place. 20 years old, lived Monroe Co. Had know the parties all her life; was at the wedding about 5 years ago; Dr. J. A. REGISTER married them. Hadn't been to their house during the marriage but it was rumored in the neighborhood that Louisa mistreated the plaintiff. Robert M. TURNER, same time and place. 36 years old, lived Monroe Co, farmer. Known the parties about 20 years. He was called to go to their house to settle a difference between them about 2 years ago; didn't know the cause of the differences but had heard of her mistreating him. Was asked if he (the plaintiff) proposed to divide the property and quit and if he did or not agree to live with her in reasonable grounds. He agreed to live with her any where except where they were then living. Asked if he understood that P. J. JEFFREYS was the cause of the trouble - yes. P. J. was about 19 years old. Frank P. Hood was known to be a quiet and peaceable and hard working man. Hayden H. HOOD, same time and place. 17 years old, lived Barren Co. Had known the defendant 3-4 years; knew the plaintiff. Said she had left his bed and left for about 2 weeks. Plaintiff asked her to return; didn't know why she had refused. She refused to cook for him, do his sewing and patching and refused to do his laundry. Hayden was the son of F. P. Hood. She refused to take care of F. P. when he was sick for about 9 weeks. During that time his father stayed in the house and that he had waited on him. His father had required a great deal of help during this time. He was asked how the defendant fed the boys, yourself and your brother - said she threw the food on the floor and said it was good enough for a dog. He said his father supplied sufficient food for them. William B. TURNER. Same time and place. 44 years old, resident of Monroe Co, knew the parties all his life. Was at the house a few times and never saw the plaintiff mistreat her. He had heard the rumor that the trouble was brought on by her son, P. J. Jeffreys. On outside of packet: This petition is insufficient and dismissed. Ok, Randy or whoever. What happened? Had Louisa been married to a Jeffrey's before the marriage to Hood? Had he been married to someone previously to have 2 sons? Were they ever divorced? Why wasn't their sufficient cause? Very interesting!     1. [SCKY] WARREN CO - COURT OF QUARTER SESSIONS CONTINUED

    3. Court met on Wednesday, 24 April 1799 - a special called session, for the examination of Charles LUCAS charged with being accessory to the death of Frederick STUMP. Judges present: Burwell JACKSON and John SHANNON. The prisoner was led to the bar in the custody of the Sheriff and it was demanded of him if he was guilty of the charge aforesaid. He said he was in nowise guilty. Various witnesses were swown in (not named) and he was examined on behalf of the Commonwealth. Then the witnesses in his behalf (not named) were heard. It was the opinion of the Court that he is not guilty of the charge and that he be discharged. On the same day a Court was again called and held at the Warren County Courthouse for the examination of William ALLIN (ALLEN) who stood charged with being an accessory to the same death. Again, witnesses were sworn in and testified against and for him. He pled not guilty. The Court decided that he was not guilty and he was discharged. The Court dissolved. /s/ Burwell Jackson.     3. I'm running late this morning. The printer acted up, my mouse is acting up, a necessary hi-density lamp at my desk burned out and it's snowing! I do not have the puzzler up yet. I'll let you know. Now to Mr. Laswell. This is taken from my book "Blood Runs In the Barrens". The victim was George Seaver The accused: Frank Laswell Type: Duel Date: January 1887 No verdict found I had to turn to a newspaper article on this since the packet didn't show a verdict. Clarence Alcock wrote a column for the Glasgow Times in the 1940's; he referenced this murder twice. I quote: "One of the most vivid and startling events was the time, in passing through the courthouse yard, I noticed a commotion about the neighborhood of A(dolph) Rapp's store on Main Street and then saw George SEAVERS and Frank Laswell leave the pavement and hurry out to the middle of the street, facing each other with drawn revolvers, slowly advancing and firing as fast as they could trigger their weapons. Laswell scored the first hit and then I saw Seavers stagger and fall. He was removed to a store and a physician summoned. It was found that the bullet had entered his chest, causing death a few days later. It was a perfect a duel as one ever read of as happening in the days of the wild west, and both men exhibited a bravery to be expected from two Kentucky fighting men. When the firing began, I got behind a big tree and, not being in the line of fine, felt safe to watch the unusual spectacle of two real fighting Kentuckians advancing upon each other, firing at every step. Sorry I cannot give the date of the Laswell-Seavers Duel, but most like other eye-witnesses of the fight are living in Glasgow today. Full details of the tragedy can be secured by examining the files of the Times of that date." On February 13, 1947 Mr. Alcock wrote: "Many thanks to Mrs. Nathan Rutledge, of Glasgow, for a copy of the extra gotten out The Glasgow News, following the fatal fight of Frank Laswell and George Seaver, the extra printed on one side of a sheet 12 x 18, is mellowed with age, but still in good condition. It is dated Jan. 10, 1887, and gives full particulars of the fight and a sketch of the principals. Mrs. Rutledge says that her father worked for Mr. Seaver, who operated the Glasgow-Burksville Star Route, and, that, although she was very small at the time, she remembers the fatal fight very well. "The News belonged to my husband, who died in 1945, and I don't know of any one I had rather have it than you," writes Mrs. Rutledge ... "I witnessed both hangings and also saw the Laswell-Seaver duel to death." (The hangings were those of John Franklin and Bob Brown). So let's look at the court records - which will be continued for several weeks: 21 March 1887. Summons were issued by the Sheriff of Barren County for Emmitt Williams, Isham Lively, N. Darter, L. W. Carder, W. W. Pace, S. T. Purcell, W. A. McQuown, Jno. A. Murray, H. Bevil, Henry Coombs, Blan Read, J. C. Evans, B. F. Trabue, John Ritter, J. F. Price, Buford McCown and John Smith. (Note: W. A. McQuown made most of the coffins during this time period. Jno. A. Murray was "Old Reb.") Barren Circuit Court, the Commonwealth of Kentucky, Frank Laswell - Indictment. The Grand Jury of Barren County, in the name and by the authority of the Commonwealth of Kentucky, accuse Frank Laswell of the Crime of Willful Murder heretofore - to wit, on the (blank) day of January, 1887, in the said County of Barren and Commonwealth aforesaid, the said Frank Laswell did then and there willfully and Wickedly there murder (paper torn) - there shooting and (missing) said Seaver with a pistol, a deadly weapon which was then & there loaded with Powder and leaden balls or other substance and from the immutive [sic] effects of which ... (rest missing). Next week we'll look at all the witnesses called for both side - quite a list!     3. Yesterday, I was contacted by a historian at a museum in Iowa concerning Merle Leroy Smith, grandson of Harmon T. & Sarah Elizabeth Carder Smith of Monroe County. Merle died in Stalag 9-B in Berga Concentration Camp, where he, along with 72 other Amercan POWs, was worked and starved to death in inhumane conditions. If you know anything about Merle or any living relatives, please contact me. Randy Jobe

    3. While I am figuring out what posts to make on these lists next, I thought I'd start the week off with a murder. Rather a gruesome topic for a Monday morning. This was reported in the Glasgow Times January 1, 1907 on page 2. FRANK LASWELL KILLED. By His Brother-in-law, Willis DEARING, At Home of Mrs. Nancy Dearing. Frank M. Laswell, of this place, was shot and instantly killed by his brother-in-law, Willis Dearing, at the home of the latter's mother, Mrs. Nancy Dearing, on the corner of Main street and Broadway, Friday night at 10 o'clock. The shooting occurred in the room in the rear of Mrs. Dearing's millinery store, which was used by her as a living-room, and at the time Mrs. Dearing was lying sick on a bed in the room, and ten feet from where Laswell fell. The story of the killing, as developed at the inquest held Friday night, was about this: Laswell's wife had been staying with her mother, who has been seriously ill for several months. Friday night Laswell went to the home of his mother-in-law very drunk, and was abusive and insulting in the extreme to everybody on the place. Finally, he was prevailed on to lie down on a bed in the room and go to sleep. He did not sleep long, however, and when he awoke he was in an even worse mood than before, flourishing a knife and declaring he intended to kill everybody there. The screams of the women caused Willis Dearing, who was upstairs, to come down to investigate, which he did with his pistol in hand. As he entered the room Laswell made a rush at him, brandishing his knife and declaring he would cut his throat. Dearing raised his pistol and fired three shots at close range, and Laswell sank to the floor and died instantly. He had been shot through the brain and heart. The first shot hit him about a inch below the eye to the left of the nose and penetrated his brain. the second entered the left side under his arms and took an upward course, coming out just above the shoulder-blade. The third shot went wild. Immediately after the shooting Dearing came to town, telephoned Marshal Collins and surrendered. The weapon used by him was a 45-calibre Army Colt's revolver. He has never been placed in jail, but is nominally under arrest, being allowed to go where he pleases. Laswell was fifty-four years old and was a cooper, having been engaged in that business here for twenty-five years. He killed George Seaver here about twenty years ago, and since then had been a hard drinker. The killing seemed to prey on his mind, and when under the influence of liquor he talked of it a great deal. He is survived by a wife and eight children. About a year ago the family moved to Louisville, where they have since lived, but he continued to make his home at his shop, near the depot, and worked at his trade here. The funeral took place Sunday after noon at the home of Mr. W. P. CARTWRIGHT, on Main Street, and the interment was in the Glasgow cemetery.
