A passing note or so. Rootsweb is having problems with some of the boards where people (including myself) aren't able to make posts to certain lists. They are working on the problem. Secondly - batten down the hatches on some of the weather crossing the country - storms and snow and ice, stay warm and safe! Lastly, a note on these vital statistiacs, both births and deaths I've been posting on Hart Co (and other counties in the past). Are they the Gospel truth? No .... they have errors. 1 - the physicians turned in the list of births and deaths annually to the county clerk's office, on tiny pieces of paper as I have explained before. They were supposed to record the event and the date as the occasion occured. Many doctors forgot - some papers likely got lost. They had to reconstruct who they had attended during the year and sometimes took a guess at the spellings and dates. 2 - many physicians did not know the families they were attending. They would ask other family members the information about the name, where they were born, parents' names, their place of birth, etc. As happens sometimes, the information given was incorrect. 3 - When the doctor turned in the papers to the County Clerk, he had to record it in those big books we just love (not). The Clerk had to read the doctor's handwriting. Enough said (sorry!). 4 - Then comes people like you and I who transcribe what the clerk wrote who had transcribed what the doctor had written - taken from the older microfilm most of the time with all its blears, ink stains, etc. I have mentioned before that one doctor in one KY county might not have kept good records as all of his births and deaths for the year all occurred on the 1st or 15th of the month. He must have been exhausted! So these vital statistics, like any record, need to be taken under advisement to be proved or disproved by other documents. If we can find no other supporting documents, we can use these dates but know that we weren't there to see the event so it could be wrong. Her family adopted his grave and she would like to contact any remaining family. Milburn Young was born on 22 May 1922 in Warren County, mother is listed as Pearl Scroggins in the KY Birth Index. Says he was born in VA and resided there until 1795 when he moved to KY; has lived in KY ever since, resides in Hart Co. Knows of no one who can prove his services except Jeremiah DAWSON. Court examined Crump under interrogations by the War Dept. Stated he was born May 1765 in New Kent Co; resided in Bedford Co VA when he entered the service. Affadavit made by Jeremiah Dawson 9 Oct 1832 who states that he was in the service with Curmp in the company commanded by John Calloway and has been acquainted with him ever since and resided near him ever since. *** DEFEVERS, John and Nancy, VA, W 1834 BL WT 31, 432-160-55. Name also written to look like LEVEVER. District of KY, Green Co, 21 Mar 1826. From Hart Co, made application in Green Co in open court. Age about 73; enlisted for a term of 3 years about Jan 15, 1776 or 1777 in the 13th VA regiment commanded by Col. RUSSELL; enlisted under Lt SPRINGER and was attached to Capt James HOOK's Company on the Continental establishment. Was in the battles of Germantown, Brandywine and Marsh Hill. Stated that his wife was age 54; his children are poor and not able to lend him any support while supporting themselves and their families. John EMERSON made affadavit in Green Co. Said he knew the soldier during the Rev. War and knew that he belonged to the 14th VA as shown above. (At a later date). Widow was Nancy who applied for a pension, provided a certified copy of their marriage from Hardin Co KY. It read: John Defevers and Nancy HUSTON, married by Jonah DODGE, a regular authorized minister, Apr 17, 1794. Marriage license issued but not returned. She applied for pension at age 77 on July 25, 1885 in Hart Co and stated that John Defevers died in 1839. Rear tire blew out - Roberson driving. He was thrown clear of the wreckage but Shaw was pinned under the motorcycle. I often miss out on the chance to guess because I am often behind the time line, but I always read them and guess to myself. My puzzler for this past week was: If a person in the earlier times signed with an (X) did this mean that the individual could write, could not write or either. Our first response would be "they can't write!" Well, not necessarily. Sometimes people signed with an (X) for several reasons, one of which you might not have thought of. First of course, would be a physical handicap that kept them from signing; Health - too weak, a deathbed will (always requiring witnesses), even blindness. But there was another obscure reason that goes back to "olden times". Remembering back in your history classes; what was always required to accompany a royal proclamation or order from the king or ruling authority? It wasn't legal until the SEAL was placed on the document. Anyone could have falsely signed a document, but if the seal was on it, it was considered legit. Now in early America and in Kentucky, few people had their own rings to place a seal on a document to make it authentic. But ....... they used what they had. The signature wasn't as important as the seal so to mimic a seal, they put an (X) on the line. This was rare but did happen. I found one of our family who was a direct descendant of an English family of some note and I KNEW the individual could write; I'd seen his signature - beautiful handwriting and it was his writing, not a clerk's. But on a transfer of land it was signed with an (X) "his mark". He wanted it to be official. So, though normally when we see an (X) instead of a signature; it does mean they couldn't write. Sorry--but a correction is in order--I was mistaken. I surprised myself to find that I did have the date of the Skaggs Creek Deed of purchase by Benjamin Payne: 1823. So, Polly's date of 1821 may accurately reflect the time of Benjamin's arrival in KY. It would also seem to support the notion that she and Benjamin were already married before coming to KY--maybe for several years prior. "Kentuckians in Death Notices of the Nashville Christian Advocate, June-December 1857," by Jonathan Kennon Thompson Smith. (About 100 names appear in this article, but only a few are from SCKHGS area): "July 16, 1857 POLLY PAYNE, nee MARTIN, died Barren Co., Ky., June 5, 1857; lived to be almost a century old; born in Albemarle Co., Va.; married Benjamin Payne who had first married her sister who died; moved from VA to Barren Co., Ky. in 1821, where he died 1832; mother of 8 children, 4 living." -------------- This was the MARY "POLLY" PAYNE named in Benjamin's Barren County Will (w.p. 1832), but I had never seen her maiden name, MARTIN, established before--perhaps others have. In any case, I thought this was worth sharing. A marriage record (1784) exists in Albemarle County, VA, for Benjamin and his first wife, ANNE MARTIN (my ancestor), but I've never seen a death date for ANNE. The only quibble I would make with this is that I'm fairly certain there's a Barren County Deed for this Benjamin Payne for the purchase of 900 acres on Skaggs Creek, in 1818. This ancestral Payne farm was near Temple Hill, and included the Saltpeter Cave. Could this 1821 date actually be the date that Polly married Benjamin--when she first came to Kentucky, perhaps? Benjamin and Polly were Methodists, and are named in early church records compiled by Clayton Simmons--sorry, I don't recall the name of the church. Jacob DRY, North Carolina, R3097. Allen Co, 12 May 1842. Jacob DRY, age 78, said he enlisted in 1779 as a substitute for Jacob CRONEN? under Capt OSBORN in a regiment whose higher officers were Col. Caleb FIFER, Major WRIGHT or WIATT and Major HARRIS. The last one named conducted the compamy from Mecienburg (sic) Co NC to the siege of Charleston; Fifer and Wright having been officers of the militia at home and did not accompany Osborn's Co on this expedition. On reaching Charleston by descending Cooper's River in boats. He enlisted again from Mecklenburg Co NC; says he was born in 1764. There may be someone in TN who could testify to his service; but he doesn't know of anyone now living who served with him. He was 16 when he started to Charleston, that being the day he was put on the muster roll. Affidavit of William THOMAS in Allen Co, 1852, said he had known Jacob for ever since 1799 and since that time had lived within 6-7 miles of him. There is a paper in the file as follows: "December 11, 1781. This is to cesrtify that Jacob Dry, a soldier serving under General RUTHERFORD in his brigade in Colonel Phifer's Battalion, has served a full tour of duty and is hereby discharged by him. /s/ Major James KARR. Dry also declared (date not shown) that he was 94 years old, entered service in 1779 as substitute for Jacob Cronen, went into service in Charlotte Court House NC and served fodr 3 months, taken prisioner by the British. ** John BOMAR, Sr. VA, S2383. State of Kentucky, Hart Co, 18 May 1833. Above named soldier states that he is age 75, enlisted in the VA militia 1779 under Capt COBB undser Col William McDANIEL. When he enlisted he resided in Halifax Co VA and it was in that county that he volunteered and rendevouzed at Williamsburg VA. He marched on the expedition against the British in Williamsburg; marched with troops to Petersburgh, thence to Jamestown, then to Hampton, then to Portsmouth and etc. Was discharged at Williamsburg VA having served 3 months. He enlisted again in March 1780 and was drafted for 3 months; served under the same Capt. Rendezvoused at Salsburg NC; served 5 months. States on interrogation that he was born in King and Queen Co VA the last day of July 1757. There is a record of his age in his father's Bible which he has often seen and is possession of one of his brothers in Halifax Co VA. He moved about 25 years ago to Hardin Co KY (now Hart Co) where he still resides. He continued to reside in Halifax Co from the close of the war until he removed to KY and settled in Hardin Co. In his present neighborhood, his acquaintenances and friends are Samuel DURHAM, John B COBB, William B BROWN (clergyman) and John HAWKINS. Sandi, Thanks for sharing this! A similar circumstance occurred with my great great grandfather, Elzia Arterburn (1801-1881, Monroe County), in that an "X-his mark" appears in the middle of his name on his Will. But there are plenty of other occasions--Deeds, court receipts--where his signature occurs or was recorded without an "X," including Deed recordings where the clerk bothered to more formally illustrate the intent of the seal with squiggly lines and the word, "seals." Some clerks evidently paid more attention to this kind of detail than others. Using only an "X-his/her mark" would have been simpler and faster, though, when a clerk or his assistant was faced with the laborious task of recording documents by hand. In Elzia's case, I suspect he may have been ill or on his deathbed when the Will was drafted, which would also explain the "X" on his Will. Thanks, Charles R.
