What I'll be sharing is courtesy of Kandi Adkinson whom I cited yesterday. I hope this will take some of the mystery and confusion away! Let's start with the highlights in Land Grant history: Under the King's Proclamation of 1763, the British government declared land would be awarded to veterans of the French & Indian War in lieu of cash. Land grants authorized by these military warrants can be found in the Virginia and Old Kentucky Land Grant Series. Names of soldiers receiving warrants for service in the French & Indian War are included in Philip Fall Taylor's publication entited "A Calendar of the Warrants for Land in Kentucky Granted for Service in the French & Indian War." This is published by the Genealogical Publishing Co., Baltimore, MD, (c) 1967 and is available in the KY Historical Society Library. After the Revolutionary War, Virginia continued and expanded the land grant system through its Land Law of 1779. Kentucky, in turn, reaffirmed the system after separation from Virginia when the Kentucky Act of 1796. The land grant system is still in use today as a method of appropriating Kentucky land. Structurally, the process has changed very little since its inception. Administrative duties have shifted, but since 1934 all original land records have been the responsibility of the Secretary of State's office. What's involved? What is a land patent? "Patenting" refers to the system of land appropriation used in Kentucky to transfer land from the Commonwealth to an individual or a group of individuals. All deeds trace back to an original patent recorded in the Kentucky Land Office. Land patenting consists of four steps, all of which must be completed before title is granted. [NOTE: Unlike deeds where one individual is selling land to another individual - this is land owned by the Commonwealth (State) and transferred to an individual or group of individuals. sg] Let's start looking at these steps - I'll cover step one today. Step #1: The Warrant (also called the Certificate or Order). This document authorizes a survey to be made. It does not specify the exact location of the land, although Revolutionary War Warrants were supposed to be used in the Military District located south of the Green River - there are some exceptions. Present-day County Court Orders (Warrants) are to be used within the county in which they were issued. A count of Virginia & Old Kentucky Patents, labeled "Military" by Kentucky Historical Society researchers, reveals that only 11% of all patents in both series were awarded for military service. The remainder were authorized by such warrants as settlement certificates, preemption claims, treasury, importation or village rights warrants; and special Acts of the General Assembly, such as "for relief of poor persons, "for surveying," and for seminary funding. It is imperative that the researcher study the type of warrant authorizing the patent in order to understand why the patent was issued. It should also be added that warrants could be traded, sold, or reassigned, in whole or part, anytime during the patenting process. We strongly advise researchers to examine both sides of warrants when studying the patenting process because assignments are recorded "on the back." Next week - Step #2 - The Entry. I've made an "executive decision" this morning! In social media, Thursday is always called "Throwback Thursday" - whoever came up with that term! People post pictures of themselves or their family from the past. Well, I'm going to make Thursday "Teaching Thursday" on both the SCKY and KYBARREN lists. I've found through the years that many of you are really good at reading census records, marriage records, etc. but are missing things on your family searching because of not knowing a lot of the why's and how's and where's. I've already started the posts on what records are kept in KY and will finish that soon. One thing that researchers look at are these land grant records I've been publishing. But, do you all know what a land grant is? Who qualified for them? What steps had to be taken in order to occupy the land? Those of you have copies of my land grant series to daTE, will find the full explanation in the preface to the books so don't have to take notes. But, for the rest of you, I want to take you step-by-step through the process and what all was involved. I will use as my source the explanation given by Kandi Atkinson, formerly of the KY Secretary of State's Office, Land Department. I will also be calling on Bill Utterback who is on these lists, to toss in any comments he would like - further explanations, clarifications, etc. He is an expert in the land records in Kentucky and teaches classes on it. It is a complicated process and I won't go back to prior Kentucky days except to touch on Virginia, our "father" state. At the end of this series, I might toss out a quiz for you which you can return to me as a Word document. I think a lot of this will make a lot more sense to you. This will not be a repeat of anything I've posted on the KYRESEARCH list although I have talked about how people acquired land in less depth there. I hope you will enjoy this series and learn from it - then, if there is interest, I'll move on to another topic. I'm starting with some cemeteries that have no names and little is know about them. 304 - UNNAMED #1: On the N side of the highway, almost opposite the old Power Mills Post Office. 305 - UNNAMED #2: S of Hwy 88, abt 1/2 mile W of Munfordville, across hwy from the Rush Cemetery. 306 - UNNAMED #3: Abt 1/4 mile NE of ___ and the same distance from the Cherry Springs Baptist Church. 307 - UNNAMED #4: A large cemetery on the side of a hill just W of the Old Iron Forge that was once oeprated on Big Brush Creek in Green Co. Now covered with just small trees; between the old and new highway. 308 - The late Judge Cann also listed other random cemeteries: 1. Near Rocky Hill about 1 mile S of the Rocky Hill Methodist Church, located on the Radar Hollow Hwy leading from Munfordville to Priceville. 2. On the N side ofd the Munfordville-Linwood Hwy and 1/2 way down Ramsey Hill very near the highway. One grave. 309 - VANCE CEMETERY: On the late farm of Marvin Vance in the Round Bottom section of ___ Green River; about 2 miles NE (part of description missing). 310 - (CHARLIE) VANCE CEMETERY: Abt 1 mile N of the old Powder Mill Post Office, on W side of Lynn Camp Creek. 311 - WADDLE CEMETERY: Just S of an old road known as the Pole Bridge Road leading to Kessinger, about 1/4 mile E of Kessinger. One marked grave. 312 - WADDLE CEMETERY #2: Turn off Hwy 8 near Mt. Beulah onto Reuben Childress Road. Located in a barn yard, one tombstone. 313 - WAGGENER CEMETERY: Per Judge Cann, cemetery is located on the farm of Lester Timberlake on hwy between Munfordville & Linwood; about midway. While everyone was shooting off fireworks and enjoying a picnic, I kept busy. As you know I am working on a series of books on the land grants in south central Kentucky. I finished two more, with the final one coming soon - on Warren Co. Note that these aren't just military land grants - they are all the grants. The information below is for Cumberland County and Green County. All the counties I'm researching tie in together and you will likely find one of your ancestors dipping his toes in a creek in one county and find him later in another county as the State divided up the counties. Much can be learned from these grants - families that all chose land close to each other in the same time frame; two men who went in together to get land ... so many familiar names. Here's the information: Cumberland County Land Grants 1799-1923. Third in a series of books exploring the land grants in south central Kentucky. Following the same format at the first two volumes, this book contains 2,957 grants during the time period shown. Included also are definitions, steps for obtaining a land grant, corrections to other lists and a list of the major waterways in the county. 64 pages plus approximately 20 pages of supplemental information. Not indexed; book is self-indexing. Green County, KY Land Grants. The most critical of counties for south central Kentucky research, Green County was formed in 1793 from Lincoln and Nelson Counties. It is the parent or grandparent of many other counties and many of the names found there will later appear in other counties in the area. Approximately 1,400 land grants are listed. The library has a collection of over 50,000 volumes with thousands of family histories and privately owned genealogies. It has a large surname file collection, query card file, BIble records, church records, newspapers, maps, manuscripts and journals published by other societies. Also are published county records, computerized lists, microfilms, vertical files - some available for purchase. They also have a photographic archives, a rare book room, records of the emetery Records project, vital statistics card index, tax lists and more. Their website is: http://history.ky.gov/. This is the repository for the state's permanent public records. It houses original and microfilmed records which include city, county, state and judicial. Thereis an area about 86,000 cubic feet of original records and 22,000 rolls of microfilm. They have the Draper Manuscripts, some genealogical collections, some early newspapers and historic maps. All the county court records microfilmed by the Mormon Church in the 1960's are available here. Counties in KY send original documents that the county cannot continue to retain here. All census records are available, the 1840 census of Revolutionary War pensioners, and extensive military records. The Adjutant Generals' records are to be found here. Check http://www.kdla.ky.gov/ for hours and more information. The staff here is outstanding and helpful. You can call for the original documents; photocopying is available. I am searching for the gravesite in Hart Co., KY: Susannah (nee PHELPS) BOARD, born ca. 1796, died 25 Sep 1854, Hart Co., KY> Her husband Christopher "Kit" BOARD, son of James and Mary (FERGUSON) BOARD, is interred at the Craddock Cemetery, aka Board - Craddock or Craddock - Board. Dates for CHRISTOPHER BOARD (born Franklin Co., VA, died Hart Co., KY): Aug 13, 1795 – Oct 16, 1885 (CRADDOCK - BOARD Cemetery, gravestone inscription, found online). Christopher BOARD married Susannah PHELPS, 7 Jun 1819, Franklin Co., VA (marriage bond, Moses FERGUSON, surety). Susannah PHELPS, daughter of John Phelps III, was born ca. 1796, Bedford Co., VA; and she died September 25, 1854, Hart Co., KY (KY death certificate). I am a descendant of John PHELPS III, through another daughter Sophia PHELPS who married Moses FERGUSON, of Bedford & Franklin Co.'s, VA and Monroe Co., KY. John PHELPS III was a son of Lieut. John PHELPS II (Revolutionary War) & Jemima TURNER of Bedford Co., VA; and John III was a grandson of Col. John PHELPS (VA House of Burgesses, Colonel in French-Indian Wars, Court Justice, of Lunenburg / Brunswick / Bedford Co.'s, VA). No further information. 289 - TAYLOR-YOUNG CEMETERY: In Monroe, KY. No further location given - another tiny cemetery. 290 - TERRY CEMETERY: On a high ridge just west of Concord Baptist Church; abt 2 miles S of Bonnieville. 291. THOMPSON CEMETERY #1: On the W side of 31E; abt 1 mile S of Uno & abt 200 yards from the highway. 292 - THOMPSON-BRATCHER CEMETERY: On possibly the Frank Thompson farm, also known as the Lee Thompson home; later occupied by Ermel Wilson. West of Cub Run off Hwy 88 (Cub Run Hwy) on the Cub Run Cave Road. Turn left abt 1/2 mile past the home of Hurley Kessinger onto an old road bed that is only passable by a 4-wheel drive vehicle at best. The home is now gone, there is a grove of silver-leaf poplar trees by where it stood. The old barn is still standing (or was?) and the cemetery is on the hill above the barn. 293 - THOMPSON-COBB CEMETERY: Near the intersection of US 31E & Bunnell Crossing. 294 - (OLD) THOMPSON CEMETERY: Abt 100 yds S of Hwy 88 & about 1/4 mile SW of the Big Winds Store. Abt 3 mmiles W of Cub Run. 295 - THOMPSON-ROBERT STOCKTON CEMETERY: Uncertain - maybe 2 miles W of Uno where an old seminary stood. 296 - TOMS CEMETERY: On the Tom Slaughter farm, 1 mile N of the Pascal-Legrand Hwy and about 1 1/2 miles NE of Legrand. 297 - THREE FORKS BAPTIST CHURCH CEMETERY: Hammonsville, KY. 298 - THREE SPRINGS BAPTIST CHURCH CEMETERY: Across Hwy 677 from the church. 299 - TIMBERLAKE CEMETERY: 1 mile E of the Boiling Springs Baptist Church. On a hill on the left side of the road passing the church. 300 - TOSH CEMETERY: On the S side of Hwy 88 at Monroe, KY. Behind a white house; a few hundred yards west of the store at Monroe. This might also be the Thomas-Young Cemetery above. 301 - TROWBRIDGE CEMETERY: Abt 1 mile from Pascal, KY; about 100 yards S of the Trobridge Spring. 302 - TRUE CEMETERY: Just off new 31E and on old 31E between Bearwallow and Horse Cave. 303 - (JAMES) TURNER CEMETERY: In the edge of Green Co, on the E side of the Little Barren River where it empties into Green River; about 1/2 mile W of the Old Salem Cumberland Presbyterian Church. While I had about 2 weeks respite from posting, I finished the 2nd in the series of Land Grant books. This new one is formatted like the one on Barren County. The write-up is below. Land Grants 1815 through the 1920's for Allen, Hart, Metcalfe and Monroe Counties. A listing of the land grants for these counties, correcting errors found on various sites and from Jillson's original transcription. Shows name, total acreage, the date land surveyed, book where recorded and the nearest waterway. Many transcription errors can be found in other listings which I have attempted to correct - in spelling of names and names of the waterways primarily. Each of these counties have a close connection and one will sometimes find individuals with grants in more than one county. 103 pages which includes not only the listing of grants, but the waterways found in each county, a detailed explanation of the process of land grants, step by step. Also includes an in-depth list of the terms used in the old land grants and deeds.
