Not being sure how Henrietta STRANACK was related to the three men of the earlier query, I had a look at the public member tree on Ancestry - Stranack Family Tree - and if it is accurate, then the parents of William d. 1849 (father of John, William and Stephen) appear to be the same parents of Henrietta above so they were sibling and the three STRANACKS above were Henrietta's nephews. Balju looks to me like a corruption of or variation on a Dutch word related to "baillie" or "bailiff" or some such word. Differences between legal systems could of course mean that the exact duties of the functionary so named could be very different and that a different word might be used in English. In Scotland a bailie is a kind of magistrate, while Baillie is the name of a Covenanting Minister of the 17th Century and of a 19th century poetess. The word comes from a French word meaning an open space within the walls of a castle (a certain style of early Norman castle in England is known as a "Mott and Bailey" castle, the Mott being the main defensive tower. These words are almost certainly related to each other, but in various ways. There is also the present-day surname Baillieu, which as it happens is the name of the present Premier of the State of Victoria and of the long-established firm of stockbrokers in Melbourne which involves some of his relatives. Balju seems closest Baillieu if you say it out loud. It all goes to show that spelling is a flexible matter and one should look past it to find the meaning and origin of a word. Sheriff is another interesting word of interesting origin -- it's from Arabic, via the various Muslim conquests in the Mediterranean. I have compared your transcription to the photos of the original document and I consider it an accurate transcription. "By Representage" is simply another way of saying "represented by" because in Roman Dutch law married women and children lacked legal capacity. Not having the legal capacity to act, in law, for themselves they needed to be represented by some kind of guardian - a parent, a husband, or an official guardian appointed by the court. The principle continues to be used in all legal systems today, and in my own case the court in Britain declared me to be lacking in legal capacity because I have a debilitating mental illness. The court also appointed the Office of the Official Solicitor to act in my stead - and so the Official Solicitor represented me in court. Hi Keith The Dutch version is baljuw, but it is a term which has had many variant spellings over the ages: Bailluw, Baliow, Ballif. The linkage to the English term Bailiff can be clearly seen in these variants. A charter granted to the people of Holland on 26.05.1480 by Duke Maximilian notes in article 9 that [Van Leeuwen] "..no baljuw, schout, nor dikereeve, within the towns or villages, shall administer justice except in a public court... " (Source: see 1 below, Van Leeuwen p 353) The baljuw used also to enjoy 1/3 of all forfeitures occurring in their districts in all corporal and criminal cases; and for the other two-thirds they were obliged to account to the Count. (Van Leeuwen, p354) There was also a "Court of Baljuw and well-born men" - the Hooge Vierskaar. The South African Legal Dictionary, quoting Van Leeuwen, makes reference to a Baljuw (or Aesge) in early Frisian law too. (SALD, p 2) Jan Matthyse's Rechtboek v.d. Briel, written in abt 1400, also makes reference to the office of Baljuw. With respect to the word's "ancestry": Baljuw is most probably derived from the Old French Bailie, which in turn is derived from medieval Latin bajulus. Bajulus was i.a. the term for someone who bears burdens, also a letter-bearer (SALD, 60-61) Sources: 1.
