According to William Lazarus's Confederate Military Service Records which is on file at our State Archives, he was a member of Company H 39th Alabama he was alive for the surrender of the regiment in 1865, with the rank of Captain, CO was Joseph Clayton of Barbour Co. Alabama, and Martha Solomon's Widow's Pension stated he died five years after the war contact Ken Tilley he can provide you with the information at ktilley@archives.state.al.us, He sent me the Widow's pension but I have since lost it plus the service records.
