Good News: The Adams County, Nebraska Historical Society wanted the names of people buried in the cemetery attached to the Hastings Regional Center, a mental institution. They were denied access by the records custodian. The Historical Society said that the information constituted death records http://www.rcfp.org/news/mag/33-1/unearthing_an_unusual_privacy_battle_1 9.html>, not medical records that might be covered by HIPAA, federal Health Insurance Portability and Accountability Act of 1996. The high court in Nebraska agreed. The Nebraska open records law provides that medical records "other than records of births and deaths" may be withheld from the public. The court found that the cemetery information fell into the death-record category because it was even more limited than what is released to the public on an actual death certificate. Furthermore, the data sought did not describe the diagnosis or treatment of the individuals at the facility -- just their names and locations of burial. The court held that "HIPAA, does not bar release of the information" and, in fact, "provides for release of information when required by state law." As the records here were death records under Nebraska law, the court said, they must be released! WARREN connects thro his son Moses Wilkderson Sellers 1796/1868 Clarke Co., In JACK SELLERS connects thro JAMES MANSON/MADISON SELLERS 1831 NC/ and probably James Sellers ca1795 and probably John Sellers and Margaret in Haywood Co., NC (recheck these memory notes) I believe Georgia and perhaps others connect him to a ROBERT SELLERS,SR from Burke/Orange/? It looks to me like they are one and the same: Warren Stewart Sellers, born born August 24, 1919 in Sellersburg, Indiana (me) son of Warren Stewart Sellers, born in Sellersburg, Indiana on July 16, 1900 and died at the young age of 20 on March 3, 1921 in St. Louis, Illinois son of Pinckney Sellers born in Sellersburg, Indiana on April 27, 1868 and died in Wood River in 1937, buried in St. Louis son of Absolom Littell Sellers born in Sellersburg, Indiana on October 26, 1824 and died in Sellersburg, Indiana on March 25, 1870 son of Moses Wilkerson Sellers born in Burk County, North Carolina on August 22, 1796 and died in Sellersburg, Indiana on June 1, 1868 son of Robert Sellers, Sr. born in Delaware or Chester County, Pennsylvania on March 10, 1765 and died September 27, 1827 in Washington County, Indiana. He was a Revolutionary War Soldier. son of William Sellers (born in England) in 1725 and died 1804 at age 79. _________________________________________________ Here is some of the things I have about Robert Sellers (born March 10, 1765 and died in 1827. He was married April 29, 1783 to Sarah "Sary" Hall, who was born February 9, 1767 and died September 7, 1860. Robert is buried in Sharon Cemetary in Washington County, Indiana near the city of Salem. He was a Revolutionary War soldier and his grave has a marker to attest to that by the DAV. His wife is buried in Sellersburg, Indiana. They had twelve children: 1. John L. (oldest son) born in 1784 2. Elizabeth Simmons (Benjamin) born May 12, 1785 3, Sarah Duckworth (John) born March 22, 1787 4, Rebeccah Hartley (Samuel) born December 4, 1788 5. Anna Fisher (Jacob) born March 28, 1790 6. Moses Wilkerson (Margaret Littel) born August 22, 1796 7. Rachel H. Campbell (George) born February 27, 1798 8. Robert, Jr. (Nancy Rodman) born October 29, 1800 9. Joshuah (Martha Hume) born February 20, 1803 10. Candace Cunningham (James) born 1804 11. Young (Alice) born May 4, 1805 12. Ambrose Carlton (Sally Shepherd) born October 22, 1806 These entries I found in the Salem Historical Library: Year 1821: Trac t Book Entry of Washington County, Indiana shows that the NEqtr., Section 30, town to North (Franklin Township) Range 5 East was purchased by John Sellers (son of Robert, Sr.) Year 1827: John Sellers, Robert Sr.'s oldest son married on 27 November 1827 Mary Johnson, widow of Peter Bertau in the parish of St. Landry, Opelausas, State of Louisiana. Mary had three minor children, George, Mary Ann and Jane. John had considerable property in Louisiana as well as a quarter section in Indiana. Year 1835: John Sellers died in 1835 in Opelausas, Louisiana when he as 50 or 51 years old and on September 29 an executor was appointed in St. Landry Parish. In Indiana Moses W. Sellers, John's brother, was appointed Administrator of John's Estate for disposal of his property in Indiana. Year 1840: On 13 November 1840 Moses Sellers, administrator of the estate of John, his brother, filed the accounts and they were equally divided among his 11 brothers and sisters. Year 1846: On March 16, 1846 the tract owned by the deceased John Sellers, son of Robert, Sr. and described under the 1821 date above was sold to George C. An executive order to close the Library of Michigan A Letter from the Federation of Genealogical Societies Within the genealogical community, the Library of Michigan has long been recognized as one of the premier state libraries in the country. The cohesive Library of Michigan collection with over 180 years of Michigan history, literature and culture records and reflects the lives of not only those who remained to raise their families within the state but of millions more whose migration to other parts of the country left their footprints in the soil and records generated by their passage. Visitors come from all across the country to research at the Library of Michigan. In addressing a $2 billion deficit in the Michigan budget, Governor Jennifer M. Granholm issued an executive order in July which would abolish the Department of History, Arts and Libraries. As originally proposed, the collections of the Library of Michigan would be scattered and the building built and designed to house the state library would be renovated to house a new function. In meetings held during the Federation of Genealogical Societies/Arkansas Genealogical Society Annual Conference in Little Rock this past week, the Records Preservation and Access Committee representatives have initiated a petition drive in support of the Library of Michigan. This is the first time we have exercised this option since 2006, something of an indicator of the seriousness with which the genealogical community views this situation. The RPAC Petition became available September 6th The petition will close on the 1st of October, the date the governor's order is scheduled to take effect. The earlier one signs, the greater the impact. Although prospects for reversing this action are remote, we would not want it to be said that a state library can be closed without its users caring or for other governors to think it a politically expedient thing to do! We then ask that you urge the members of every society of which you are a member to do likewise.     3. I think "F. G. Scantling" was likely "Florence Ethel Scantling", a daughter of Charles W. Scantling and 1st wife, Mildred A. Ladd.  She was listed as "Ethel M. Scantling on the subsequent 1910 Census and as an "Asst Matron" at that same Samuel Miller school.  She was a full sister to the Frederick William Scantling in question.  I'm not sure about the identity of the rest.   Two other sisters of Fred's, Lydia and Hattie, were listed on the 1900 Census living in Baltimore, Maryland, in the household of Alex B. Randall.  I do not know what, if any, connection there was to the Randalls.  Still, I cannot find Fred, his possible father, Charles, or even Charles' mother, Mary E.     3. F. W. Scantling was Fernando Wood Scantling, and yes I do believe that Fernando was a brother to Charles W. Scantling.  I believe they were sons of William A. Scantling and wife Mary Elizabeth Clark.   Fernando and wife Blanche Shanks are buried in Rockgate Cemetery in Crozet, Albemarle County, Virginia.  Interestingly, the last name is spelled as "Scantlin" on the gravestone, without the 'g'.  Fernando's and Charles' mother, Mary Elizabeth (Clark) Scantlin, is also buried in that cemetery (Oct. 10, 1834 - Jan. 16, 1919).   Charles' son, Norman, with 2nd wife Margaret "Maggie" Graves, is also buried in Rockgate Cemetery with the dates 1901 - 1980 on his marker.   I had first traced Fernando thinking that with his initials the same as Fred's that he was a likely candidate to be his father.  However, I have since ruled Fernando out and now believe that it was likely Charles that was Fred's father.  I just can't find that one concrete piece of evidence to prove it.   Michael --- On Wed, 9/9/09, Georgia L.
