    3. Scottish Court of Sessions terminology Would anyone on the list with a Scottish legal background help with the Court of Session cases. These Court of Session events occurred around the late early 1800s, but I have absolutely no idea what the “jargon” means. (I have removed the names of the parties involved.) Can anyone give a simple explanation of the terms, please. John C. was a farmer, horse groomsman and also sold horses. They all relate to debt and failure to make payment of certain sums of money. CS271/36566 Bond of Caution by William R. in Ernamrieas cautioner for John C. in Hightae in Suspension John C. v Agnes D. (John and Ann husband and wife) in Castle Douglas. With note by James W. to Andrew M., clerk to the bills acknowledging receipt of the above, 1801 CS271/47506 Account of expenses of Agnes D. in Castle Douglas against John C. in Hightae in suspension due to John J., agent for respondent, 1801 CS271/55602 Bill Chamber Process of Suspension John C. in Hightae v Agnes D. in Castle Douglas. 3 items. Decreet, summons of reduction and inventory, 1801 CS271/69386 Note for Refusal of Bill for Want of Caution poor (???) Agnes D, in Castle Douglas v John C. in Hightae. 2 pages. 1801 Hightae is in Dumfriesshire in southern Scotland. E371/134 also relates to debt in this case postal charges. The collection of which has been farmed out to John R. and Richard H. who would have paid a sum of money for the commission empowering them to collect postal revenues. I have no idea whether this Henry C. is the same one who knew Burns since he is merely described as innkeeper in Dumfries. There is a further reference to Henry C. and this again relates to debt as follows: CS271/59738 Bill of Suspension Henry C., Innkeeper in Dumfries v John H., junior merchant in Glasgow, 1795 Before preparing an estimate for copies, we require a non-refundable search and estimate fee of £15. This will be deducted from the estimate we send out to you. If you choose not to order the copies, the fee will not be returned. Payment for an estimate can be made by cheque or online by credit card: a.. Cheques (in GBPounds) should be made payable to Scottish Government and sent to National Records of Scotland, Historical Search Room, HM General Register House, 2 Princes Street, Edinburgh EH1 3YY . This is essential for the payment to reach us promptly. We shall proceed with preparing an estimate on receipt of your search fee. We will estimate for copying pages from a maximum of five separate references. If you listed more than five separate references in your initial request, we will provide an estimate for copying the first five references only. Hi Maisie "Formulary of Old Scots Legal Documents" by Gouldesbrough and published by the Stair Society in 1985 is a wonderful help (if you can lay your hands on a copy) John C. was a farmer, horse groomsman and also sold horses. To me, this means he had some land which he farmed and dealt in horses. He had gained a reputation as a groom in his youth and that helped him to advance in business. Today's analogy would be a car mechanic who advanced to own his own garage and car showroom.
