The legislation goes back to 1555! A tenant could not be removed if he/she had a valid lease which still had years to run. The legal processes are in the sheriff court records. They are uncatalogued. All they provide is a list of names. The reasons for removal were many. Not all removals were to clear the small tenants to make way for sheep farmers. Tenants were subject to the process for not paying their rent. In many instances landlords used removal as a threat to ensure better behaviour in the future. Many tenants were subjected to a legal summons but were never removed. There is a very important distinction between removing and eviction. The initial process of removing did not give landlords the actual right to evict (that required more legal procedure). Many tenants left quietly of their own accord and did not require to be evicted from their homes by the sheriff officers. I would imagine that Kirkstone is trying to be Kirtomy. 1819 was the year when major changes were made in Strathnaver. Kirtomy became a crofting township. In 1818, in preparation for 1819, all the existing tenants were subject to process of removal, including John Macdonald,. This ensured that the landlord could re-arrange the township into crofts for entry in 1819. Why John McDonald was not given a croft is not clear. Perhaps he chose not to accept a small holding, or perhaps, for some reason, the landlord did not want him as a tenant. I was sent an email tonight from the Orkney and it said that my John McDonald was evicted from Kirkstone in the Parish of Farr during sheep clearances and arrived in the Orkney in 1820.
