    3. Hi; In a corridor of the Highlander Hotel ( now one of the Days Inn chain) in Calgary there are swatches of the various clan tartans. Incidentally they have been there as long as the hotel has existed. Looking at the tartans on Christmas Day I noted that; a) some tartans had the abbreviation "rep" against the clan name. Reid responded to a complaint by Professor Bill Waiser (submitted in November 2000) regarding the refusal of Statistics Canada and Chief Statistician Ivan P. Fellegi to transfer care and control of nominal schedules of the 1906 Special Census of the Western Provinces (Alberta, Saskatchewan and Manitoba) to the National Archivist for subsequent public access in accordance with the statutes of Canada. On 12 December 2002 Mr. Reid responded to a further thirty individuals who had submitted similar complaints. I am aware of complaints by others, including my own, that have not yet been responded to. In each response to complainants Mr. Reid stated: "As a result of this investigation, I found that access to the withheld records is authorized pursuant to paragraph 19(2)(d) of the Access to Information Act by reference to subsection 8(3) of the Privacy Act and s.6 of the Privacy Regulations. On October 18, 2002, I recommended that SC release the requested schedules. However, on November 1, 2002, Dr. Ivan P. Fellegi, Chief Statistician, informed me that he does not intend to follow my recommendation." This finding supports the position of the National Archivist, Ian E. Wilson, who has requested transfer of the records in question to his care and control. It supports also the findings of the Expert Panel on Access to Historical Census Records that, in June 2000, recommended the immediate release of the 1906 Schedules of Census with the orderly release of subsequent Censuses, 92 years after collection, in accordance with the Access to Information and Privacy Acts. Makeup of the Expert Panel included, among others, the Honourable Gérard La Forest, retired Supreme Court Judge, and John McCamus, Professor of Law at York University. Mr. Reid's findings are supported by the legal opinion of Ann Chaplin, Senior Counsel, Constitutional and Administrative Law, Justice Canada (1 August 2000). Ms. Chaplin, unlike those giving opinions before her, considered all aspects of the situation, including the four Statutes of Canada that have a bearing on this issue (National Archives of Canada Act, Statistics Act, Access to Information Act, and Privacy Act). Ms. Chaplin came to different conclusions than those before her that considered only the narrow aspect of a 'Secrecy' clause in Instructions to Officers and Enumerators of Census. During the entire tenure of Dr. Fellegi as Chief Statistician of Canada, he has opposed public access to Historic Census Records, and has refused to transfer care and control of those records to the National Archivist in accordance with the applicable legislation. In so doing he has contravened legal provisions of the National Archives of Canada Act, the Access to Information Act, and the Privacy Act. By extension, it might be considered that the Minister of Industry, being the Minister Responsible for Statistics Canada, has also been in contravention of these Statutes. With the possible exception of the Privacy Commissioner, Chief Statistician Ivan Fellegi stands alone in his opposition to public access of 92-year old Census records. All studies and surveys to date have supported such access. Mr. Minister, I mean no disrespect to either yourself or Dr. Fellegi. It is time, however, that the Chief Statistician was directed to obey the laws of Canada. No civil servant, no matter how high ranking, is above the Laws of Canada. We call on you to direct the Chief Statistician of Canada to obey the law and immediately transfer care and control of Nominal Schedules of the 1906 Special Census of Western Canada to the National Archivist. If, after being directed to do so, Dr. Fellegi refuses still to turn care and control of these records over to the National Archivist, he should be replaced with someone who is prepared to obey the Laws of Canada. A closer look at a census page showed me that three of my father's siblings were born in Canada. Unfortunately it doesn't say where. Their name were Mary Jane Stewart (born c1883) and George and William Stewart (twins, born c1886). My basic need is a suggestion as to what records might be available to me so that I can check this out further. Anything would be appreciated. All the best from Edinburgh, Roy. I didn't peek (honest).........but you know who was so tired and exasperated after his annual Christmas shopping trek (usually about three hours long) he just handed me the bags and disappeared til suppertime.     3. Dear Jan, I'm no expert, but my recommendation would be to use the Family Search "Personal Ancestry File (PAF) software for new users. It is a full featured software that has a great deal of support behind it and seems to be better than a lot of other software in accepting files created by other programs. Best of all it's free and can be downloaded from the web today. I currently use Generations by Sierra, but they no longer support it and it will not export a clean GEDCOM file for others to import and use. I'm in the process of changing over to "The Master Genealogist" at http://www.whollygenes.com but I'm waiting for them to release a new version that will convert my old files. Here's the FamilySearch.com website page where you can download their software. Highlight and copy all of the lines below and paste them in the address field on your Internet browser. Then say "go". Chose the top selection on the page for their 5.2.18.0 version of software and click on the "Download" icon - that's all there is to it. It will take a while for it to download then follow the instructions it gives you to install it.     3. I, too, use Family Tree Maker and have updated several times to keep up with new features. I like the way it remembers locations although once in a while there will be a similar location that pops up and you have to check it to be sure you got the right one (for example same city, different state). I also like the system for entering sources. And I would urge anyone from the beginning to enter a source for every fact--even though it is extremely tedious. Otherwise, later, you start wondering how do I know that I know that--even if the source is just "Aunt Jane" A hint for entering sources. If you have a bunch of facts from the same source, like an article or a document, you can enter a few "zeros" at the beginning of the name of the source. It will temporarily move that source to the beginning of your list. Then you can easily click on it. When you finish that series of entries, remove the zeros and the source will be returned to its alphabetical spot. I have at least 12,000 names dates and locations in mine and it seems to handle them very well. And YES entering everything I had collected before I got my software was a long job, (months) but family tree maker would tell me when I made a mistake and typed in a date wrong and had someone being born after both parents were dead, and if I typed in say for example Winnipeg, Manitoba , Canada as a birth place it remembers that and when you type in Wi in the birth place for another person it fills the rest in. You 've got to love that. I've also heard good things about Brothers keeper software but never tried it.     3. Hi Janet: For someone just starting out in genealogy, I would recommend Legacy 4.0. It's not too pricy, mine was about $14.95 US. It's intuitive, comprehensive, and has lots of nice features. Best of all you can download a copy of it free on the net and try it out. If you like it, Santa can buy you the version with the CD and manual. If you don't like it, or it's too simple, look at the Master Genealogist, Gold Edition (about $150.00 Cdn.). I have both, but right now I mostly use Legacy.     3. Greetings All. I forward for your interest the following message relating to the Online 1901 Census of England and Wales. There is a number of interesting items contained in the meeting minutes referred to. I found most interesting the following facts. There have been approximately 17 million free services, and 2.3 million paid services provided by the site to users during the testing phase. Of these paid services, fully transcribed details were the most requested, followed by images and then schedule requests.     3. Greetings All. As promised in my message on Wednesday, I have placed online the full text of Professor Bill Waiser's press release held 18 December 2002 at the University of Saskatchewan. The press release was in response to the long awaited response by Information Commissioner John M. Reid to Professor Waiser's complaint about Statistics Canada's refusal to allow public access to records of the 1906 Special Census of the Western Provinces. The Information Commisioner found that access to the withheld records is authorized pursuant to paragraph 19(2)(c) of the Access to Information Act by reference to subsection 8(3) of the Privacy Act and s.6(d) of the Privacy Regulations. On 18 October 2002 he recommended that Statistics Canada release the requested schedules. Chief Statistician Ivan P. Fellegi advised the Information Commissioner he does not intend to follow that recommendation. In so doing we believe that he is breaking the laws of Canada. No public servant, no matter how highly placed, is above the law. We call upon Industry Minister Allan Rock to immediately direct the Chief Statistician to transfer care and control of these records to the National Archivist for subsequent public access.
