D. ***** On the hearing of the petition at the time their heirs at Law of Henry Gassaway and their representatives were cited to appear on 6 Feb 1858 came Jacob Butt Senr and objected to the sale of the Lands in said petition described as the property of Henry Gassaway decd because he alledged that he said Jacob Butt Senr was Legally entitled to the whole thereof by purchase from said Henry Gassaway & by grant from the State but preferring that the title should be tried by another tribunal I gave the above matter decree.
