In the table for Fairfield you said "date created 1800" then you said "Formed from Fairfield County in Camden District(1785)" I am not sure if I understand what is meant, but I suggest we go by "South Carolina A Guide for Genealogists" by Theresa M. Hicks copyright 1985. I have known her since the early 1970s. She is a professional genealogist & studied the Statutes at Large to get her info on creation & modification of counties since that is the series of law books that record such. That or something similar is her source. Anyway page 80 says "In 1768, Judicial Districts were created. [Statutes, Vol. 7] They were not actually functional until 1772 or later ... The Act of 1768 provided for sheriffs and the building of court houses and 'gaols.' Under the Constitution of 1778, Ordinaries (later called Judge of Probate to be chosen by the Senate & the House were to be appointed in the several districts, and until the appointments were made, the Ordinary in Charleston was to continue. The Judicial Districts were made Courts of Ordinary Nov. 3, 1781 and continued until Courts of Ordinary were established in each county. Land conveyances, if recorded prior to 1785, are in the so-called Charleston records which covered the entire colony/state. Boundaries of the Judicial Districts under the Act of 1768 Cheraws: ... Charleston: ... Beaufort: ... Georgetown: ... Orangeburgh: ... Camden: ... Ninety-Six: ..." OK so now I have given the 7 Judicial Districts that were created in 1768. That is the year the set of archives maps cite. Page 83 & 84 lists the counties created in 1785 when Camden District was cut up: Clarendon, Richland, Fairfield, Claremont, Lancaster, York (called New Acquisition), Chester. Considering that you need dates for your boxes, I know this is messy. Even Mrs. Hicks is being fuzzy, probably because the statues only say what was to happen, not what actually happened. We can only infer what actually happened by looking for records in Charleston vs. Camden vs. Winnsboro (and now Winnsboro & Charleston records are in the State Archives in Columbia & maybe Camden as well by now). Anyway, my suggestion would be to say that Camden District was created in 1768 because that is the date the Archives cites. Then under the table for Camden District, you might say that Wills (Ordinary > Probate) started Nov. 3, 1781. I think I saw wills & estate packets in Camden that went back to 1782 or 1783. What is the earliest probate papers of Fairfield Residents that you all have seen in Camden? Actually I should just ask, what is the earliest probate in Camden? It does not matter what part of Camden District the deceased lived in. Also under the table, you should say deeds were not recorded in Camden District. Deeds were only recorded in Charleston until 1785 when Fairfield Co. and the other counties were created. OK as far as records & court houses go, we can forget Craven County and the other 3 counties prior to 1768 since they seem to only designate where land grants were. Everything was recorded in Charleston and it looks like everything continued to be recorded in Charleston until at least Nov. 3, 1781 when Probate moved into the judicial districts e.g. Camden District. Page 83 says "The counties created in 1785 from the judicial districts are shown on the following chart. "On March 16, 1783, the state was to be divided into counties for courts of inferior jurisdiction. The counties were to be not more than forty miles square. Proper places were to be selected for court houses and 'gaols.' Commissioners were appointed for: Charleston, Georgetown, Cheraws, Camden, Ninety-Six, Orangeburg, and Beaufort. "In 1785, the counties were established with authority to levy taxes. Then the book goes into naming the counties in each district giving the bounds of each county. You may be disturbed by the omission of Kershaw Co. which is centered on Camden. page 92 says: "February 19, 1791, Kershaw County was established ... from Lancaster, Claremont, Fairfield, and Richland Counties, ..." I wish I could say Camden District ended when the counties were created in 1785, but page 93 shows that certain courts were not in the county that are today. Page 93 says: the Status in 1791 was County court was held in Fairfield but General Sessions & Common Pleas Courts were held in Camden for Lancaster, Kershaw, Claremont, Clarendon, Richland, Fairfield & York. Furthermore, Equity Court was held in Columbia for all counties in Camden, Orangeburg, & Cheraw Districts! I guess that should be a footnote under the creation of Fairfield in 1785 that Gen. Sess. & Common Pleas was in Camden & Equity in Columbia. We have had some boundary changes with Chester Co. & 2 major changes with Richland Co. Page 96 seems to show that in 1798 that Fairfield was its own judicial district as were most counties. Also in 1798 (also page 96) Fairfield & 6 other counties were in the Northern Circuit Court. It says in 1799 Fairfield was moved to the Southern Circuit Court. Page 97 says "In 1800, the county courts were abolished, and each existing county became a district court. In 1798, there were 27 Judicial Districts." Previously I'd thought that Fairfield Co. became Fairfield District in 1800, but it must have been 1798 (or maybe earlier since Hicks does not say). Also I am wondering what the county courts were. I suppose they were wills (Judge of Probate) and deeds (clerk of court), but I don't know. We could go on with this kind of detail, but I think it would suffice to say Fairfield was created from Camden District in 1785 and not note the limitations of Fairfield County. I do not think it is important to distinguish between Fairfield being a county & a district. Page 105 says: "The 1868 Constitution declared that the Judicial Districts shall be designated as Counties." So county vs. district became merely a designation & there was no difference so I think that detail could be ignored. You mention "Fairfield County Genealogical Society". That is a nickname. It is actually the Fairfield Chapter of the SC Genealogical Society. Subscribers, Our fellow subscriber Mrs. Purvis has written a book on the brother of one of her ancestors. The book is on General A. H. Gladden who was born & raised in Fairfield County, living 1810 - 1862 AND contains genealogy of his kin. She has volunteered to do lookups in her book which is indexed. So it is on the lookups page with other books that have lookup volunteers. Should I (or someone) tell the list every time we add a book to the lookups page? Probably, but we have not, so please check the lookups web page.
