Perry Extracted from microfilm at SC State Archives: "After (expenses), I wish my Estate both real and personal to be disposed of as follows: to my daughter Martha Rutland and (heirs/hers) (Ans) one negro girl named Heater (sic) and increase. Also one bed and furniture. To my daughter Sarah Corley and (hers) (Ans) one Negro girl named (Muggy) amd increase, also one bed and furniture. The residue and remainder of my estate both real and personal I devise and bequeah to my son Ezekiah Watson Perry to have and to hold the same during his natural life and after his death to be equally divided among his children, grandchildren if there be such to take collectively what their parents would have taken if he or she had been alive at the time. (If there be no children, the remaining to be divided by the laws of division.) Appoint Ezekial Watson Perry my sole executor. 20th day of Feb., 1857. Mary (X) Perry An attached affadavit discussed her health, right mind, that she was operating the farm herself with the help of her Negroes, even being seen in the fields. She was of sound mind, and had the reputation of being a "first rate midwife". Son is referred to as Capt. Perry. One witness described her as a very old lady, who did not know her exact age, but thought herself to be between 80 and 90. She was very hard of hearing and one had to speak above a normal voice for her to understand. She had several other children beside E. W. Perry, 4 he thinks, but he does not know the circumstances in comparision with Mr. Watson Perry. He does not know who wrote the will, and Mr. Watson Perry was in the room with they arrived to witness the will. Mr. Perry gave him the will, and he read it in a normal voice, so does not think that Mrs.Perry could hear it. A later witness mentioned that Mrs. Watson had been offended by Watson's last marriage. That a son-in-law, or sons-in-laws had come and taken everything they could when her husband died, and Watson Perry had not gotten much. (my comment - maybe Watson Perry was living away at that time? There is mention of her being upset that he left the area. There was no mention of the name of her husband or the sons in law or Ezekial Watson Perry's wives. Points that were made by various witnesses: Described daughter Mrs. Corley as being poor with very little property Described Mrs. Rutland as having left 8 children surviving, which seems to indicate that she was deceased. W. Perry has some 5 or 6 children - he received 2 slave from his father. Mrs. Perry told him that Watson had received very little when his father died. Mrs. Tillman Watson and Mrs. E. Watson sworn.. Knew her for many years, and thought she was capable of making decisions altho she was growing more physically feeble. They stated that she had said that she had promised two slaves to her daughters, and altho. her daughter Mrs. Rutland was deceased, she would keep her word. Mrs. Perry stated that she had worked hard for her property and would dispense of it as she saw fit. RE: Watson Perry's marriage - she was not so much concerned about he marriages themselves, but the fact that he had moved away, and she didn't understand that as she could give him more than he could earn on his own. Billie's comment - I ran out of steam - there are 58 pages of the petition, scanned thru about 25. At the end I found that the petition that brought about all the testimony was brought by "the children of Martha Rutland, the children of Rebecca West, and the children of Matilda Mathews, grandchild of the said Mary Perry to "prove in due form of laws" the will of Mary Perry. So there may be more in equity records. I cannot identify Rebecca West - have placed her as a possible daughter, since the mention of grandchild is not plural and assume it refers only to Matilda Mathews. Also there is a reference where one witness believed there were 4 children, and I only had 3 w/o Rebecca. Can anyone help identify this Rebecca? I found NO Rebecca West in the 1850 Edgefield Co. census. I have put some of the family together from: 1. This will, 2.
