Sept 25th Mr. THOMAS CARTER enters a caveat that no letters of administration be granted until he can have a hearing as the deceased ROBERT CARTER left a last Will and Testament. (No mention of this will found in Houston's S.C. COUNTY WILLS). Page 31 Sept 25th 1786. JOHN SHARP and PATTY his wife took a citation (from JOHN THOMAS, Esq. Ordinary of 96 District) on the estate of ROBERT CARTER, late of said District, deceased, as next of kin. The same certified by Revd. ROBERT MECKLEN was read and published after divine Service 27th Sept 1786. The Kindred and Creditors to appear before PATRICK CALHOUN, Esqr. on the third Saturday in October, then next to shaow cause if any they have why the said administration should not be granted. The said Citation being returned to me as directed and no person appearing to make any objection nor no will produced nor known of in being upon oath, the said JOHN SHARP and PATTY his wife qualified. Page 15 1782 September 6th The Last Will and Testament of WILLIAM HALLUM of 96 District, deceased, dated the 9th January 1782 was Probated in the Ordinary's office the 6th Sept 1782 by SAMUEL ROSAMOND, one of the subscribing witnesses, the other witnesses JOSIAH DOWNEN and JOHN BRETTER. JENEY HALLUM (the widow) executrix qualified as such. JOHN HALLUM executor not qualified, granted letters of testamentary and warrant of appraisement, also qualified SAMUEL ROSAMOND, JAMES DOOLING and JAMES DIVLEN freeholders, as appraisers--gave also a copy of said will. 3rd Dec 1782 Inventory, warrant of appraisement and list of the division of each legatees part sent along. Returned into the Ordinary's office and recorded on pages 87 and 88 of this book. (unfortunatley most of these pages were torn away, and a copy of the will is not seen. Neither is this will referenced in Houston's SOUTH CAROLINA COUNY WILLS). Page 44 Will of WILLIAM HALLUM, of 96 District, very sick and weak. Wife JENNEY HALLUM 1/3 of "clear lands during her life and the House I now live in together with any palntation tools, and Takleings, Tables, Chairs, Bed Steds, and negro fellow Peter, with all my hogs, flour, corn and fodder for the use of the family under her care." To wife "forever" negro woman Cate, child Dinah, mare Rack, milch cow, and "bed I now ly on with its furniture, one gown pateron and seven yards linen cloath, all the yearn now in her possession, pewter dish, six pewter plats, one large iron pott, one chist, Tea ware, together with all her bed and wearing apparal that she had when I married her." To son WILLIAM HALLUM 100 acres to be taken out of the west of the plantation "I now live on", negro boy Peter, feather bed and furniture, "my Riffle Gun and Sote Pouch," Pott, a small trunk, and "my Saddle." To son JAMES HALLUM 100 acres to be taken from the homeplace, beginning at a corner tree where the survy first started, a 2 year old colt, milch cow. To son JOSIAH HALLUM 50 acres of land, the remainder of the plantation, and a milch cow. To sons "THOMAS HALLUM, ROBERT PICKENS and his wife DARKOS, negro girls Mimy, and Saly to be divided betwixt themselves as they can agree best upon." To daughter MARTHA a cow, a woman's saddle tree, bed and furniture, spinning wheel, and "Box-Iron with heaters." To JOSEPH SMITH and ELISABETH his wife the sum of 5 shillings Sterling. "To my wife's son WILLIAM GRIFFITH one two year old horse and one saddle." To wife's daughter MARGARET GRIFFITH a bed "the property of my wife before marriage together with the furniture belonging to it." To sons, JOHN, THOMAS and WILLIAM HALLUM, all wearing apparel to be divided equally. Remainder of estate not devised may be sold, and money used to pay debts or at the descretion of executors toward schooling of the children. Sheep are to remain with wife, for the use of the family, as all "Coopers vesels in the House, with some old Waton Irons and Heckle." Executors were wife JENNY, and son JOHN HALLUM. I will be posting records from the Calhoun Journal, these will be abstracts of probate records that were originally published in the Carolina Geneaoligist Magazine by Mary Bondurant Warren that is no longer in publication. I have already posted info to the Edgefield List along with estate records from the year 1800. The following explains what the Calhoun Journal was: The Revolution was still undecided in the fall of 1781. British forces held the Charleston area, with skirmishes into the piedmont. Evacuation by the British was a year away, and Cornwallis' defeat yet to come when the rebel Governor JOHN RUTLEDGE, and his "Privy Council" began to set up "legal" government again in the South Carolina back country. In an act signed 13 September 1781, "Ordinaries" were named for each of the districts of South Carolina. Appointed to serve for the Ninety-Six District was JOHN EWING CALHOUN, Esq. The following volume has been called "The Calhoun Journal" for many years, and appears to be the earliest surviving record of the Ordinary (now the Judge of Probate_ for the entire Ninety-Six District. >From one of the early entries it appears that CALHOUN gave up the Ordinary's office and was replaced, but the name of his successor (who kept the journal during the 1782-83 period) is not known. "I do hereby notify such appointments (of Ordinaries), to the end, that persons having occasion to prove wills and obtain letters of testamentary, and of administration or guardianship, or to transact any other matters within the jurisdiction of an Ordinary, may know where and whom to apply for that purpose," declared RUTLEDGE. "In order that none may plead ignorance thereof, all letters testamentary, and of administration, and guardianship which have been granted SINCE 12th day of MAY 1780 BY ANY PERSONS OR BOARDS, UPSURPING OR PRETENDING TO CLAIM JURISDICTION OR AUTHORITY...ARE AND WILL BE ABSOLUTELY NULL AND VOID..." A copy of the Ordinary act was published in British held Charleston's ROYAL GAZETTE Nov. 3, 1781. The Ordinary's responsibility was not unknown to lawyers of the time, and certain forms were in current usage. Earlier RUTLEDGE had requested PETER BONETHEAU, Esq. of Charleston to obtain copies of these forms from the British "Registar's Office." The Dedimus, often used these records, empowered a Justice of the Peace to swear executor or administrator, their securities, or persons to make the inventory and appraisement of the estate. The Citation calls on persons owing the deceased to pay up, and those with bills owed by the deceased to render their accounts by a specified time. Other forms were those of Letters of Administration, Letters of Testamentary, Bonds for either, Letters of Guardianship, Guardians Bond, Marriage License, and Marriage Bond. The responsibilities of the Ordinary were similar to those of present day Judge of Probate in South Carolina.

    3. Alexander Donald's will didn't mention James Gray or his wife. However, if James died in 1801 and if his wife had also died, they wouldn't have been mentioned. It seems rather likely that James was a brother of Andrew and Robert, both of whom married daughters of Alexander Donald, and he could have married another daughter (if so, she may have been just Elizabeth since Mary Donald was the wife of Andrew Gray). Archibald Douglass was named in the will. Phoebe could have been his cousin or he might have been a grandson by marriage. Item, I give to my Grandson Archibald Douglass One Negro man called Isack and the half of the tract of land lying at Bever Creek in Fairfield County conveyed to me from Fr. Hopkins. Item, I give to my Great Grandson Donald Douglass the Other part of my land lying in Fairfield County on Bever Creek and One Negro Woman Called Cloe and Negro Boy Called Harry And One Feather bed and furniture. Elaine Oakes > Phoebe Gray's father was James Gray (RN=4895) and was born in 1725. He died in 1801 in Laurens, SC. Her mother may have been Mary Elizabeth McDonald. It could be Donald. >Phoebe and Daniel's daughter was M. Elizabeth Cochran (RN=127) she was born in 1776, married Archibald Douglas (RN=126) in 1791

He died 12/24/1834 in Abbeville. His father's name was John Hodges (RN=51508) and he was born in Virginia. That's all I have.

    3. Are you kin to any HODGES, in Laurens Co., SC that would have been kin to a Leroy H. Hodges, that married a Permaillia/????, Leroy was born in 1806 according to the Census and moved to Abbeville, the Old 96th Disit. in 1840 and then on to Jefferson Co., Alabama in the 1850's. Any HELP on the Hodges in the Laurens Co., will be very much appreciated. Leroy is my GG Grandfather, and we can not find his Parents Names. Hodges, that married a Permaillia/????, Leroy was born in 1806 according to the Census and moved to Abbeville, the Old 96th Disit. in 1840 and then on to Jefferson Co., Alabama in the 1850's.
