Here is the Petition for Appointment of Administrator; this seems odd since there was a will, but perhaps the son Barak is not wanting to be one of the executors--after all, he was only getting five dollars! The Petition of Barak L. Rudd who is of the age of twenty one years and upwards, of the County of Cass respectfully shows: That Barker F. Rudd late of Newberg in said County of Cass departed this life in said Township of Newberg on Sudnay the 22nd day of February in the year of our Lord one thousand eight hundred and Eighty leaving a last Will and Testament, as your petioner is informed and verily believes. Which said Will is herewith filed and offered for proof and Allowance. Your Petitioner further shows that said Testator was at the date of the execution of said Will of full age and of sound mind and that said will is signed by said Testator and Attested by two Competent witnesses. That deceased was at his death, an inhabitant of said County of Cass and was possessed of Real and Personal Estate, situate and being in the County of Cass and elsewhere, to be administered, and that the estimated value thereof is the sum of Twenty five Hundred Dollars or thereabout, as your petitioner is informed and verily believes. And your petitioner further shews that the names and residence of the heirs at law of said deceased, and other persons interested in his estate, are as follows: Lucinda Rudd, widow, and Six children viz Barak L. Rudd, Nelson B. Rudd, Harriet A. Gilbert, Abigail J. Saulpaugh, Candace Stevens, Alice E. Walker. All living in Cass County, Michigan except Harriet A. Gilbert who now lives in Wexford Co., Mich. and Candace Stevens now living at Elkhart, Indiana And all named in said will as legatees And Devisees. Your petitioner therefore prays that all persons interested in said estate may be duly cited as required by law, and to this Court may seem proper, that said will may be admitted to Probate and Allowed, that adminnistration of said estate may be granted to Nelson B. Rudd one of the Executors in said will named and that such other and further order and proceedings may be had in the premises as may be required by the statutes in such case made and provided.
