Last Will and Testament Burlingham Rudd of St. James Goose Creek, Charleston District, South Carolina State of South Carolina. In the Name of God Amen! I Burlingham Rudd of St. James Goose Creek Parish, in the District of Charleston and State aforesaid, being weak of body, but of sound and disposing mind and memory, blessed be the Almighty God for the same; calling to mind the mortality of my body and that it is appointed for men once to die, do make and ordain this my Last Will and Testament in manner and form following; first and principally I recommend my Soul into the hands of Almighty God who gave it, my body to the earth of which it was made, to be buried in a decent Christian-like manner, nothing doubting at the general resurrection I will receive the same again by the Mighty power of God, and as touching such Worldly Estate as it hath pleased to bless me with, I give, bequeath and dispose of in the following manner. In premise my will and desire is that my beloved Wife, Mary Rudd, shall have all her Estate, both real and personal, that she had at the time of our marriage together with the increase thereof in lieu of any claim of dower or other wise she might have against my own Estate either real or personal, this is agreeable to a written Marriage Contract entered into at and before our Marriage. 2ndly, I wish all of my lawful debts paid by a sale of any of my Estate as my Executors think can be best spared. 3rdly, I give and bequeath to my daughter, Elizabeth Smith, and her surviving issue of her body under the restrictions hereafter mentioned, that is to say, that my daughter shall have it for her use and support until her eldest child becomes of age or marry and at that time my acting Executor or Executors will cause or have a division made of all my Estate both real and personal, giving my daughter Elizabeth Smith and all her surviving issue of her body an equal share to share and share alike after having the division made by an Appraisement or Sale as my Executor may think most proper. Then will be lots drawn by his or their order and my daughter, Elizabeth, will have her share for her use during her natural life and at their death to be equally divided between her surviving issue of her body. But it is to be fairly understood, that said property is not to be subject or liable to be taken or made use of for debt against, or by my son-in-law, John Smith, and that my acting Executor or Executors hereinafter appointed be fully authorized and empowered and directed by me to sell or exchange at any time he may see it most advantageous to the Estate and that he or they be directed with full power by me to have divisions made without obtaining any further order; and I further authorize my acting Executor or Executors to make and execute titles to any land sold or drawn by the heirs; and I do hereby nominate, constitute and appoint my respected neighbour, William Mellard, and my daughter, Elizabeth Smith, and my son-in-law, John Smith, my Executors and Executrix to this my last Will and Testament. Hello to all my Burlingham Rudd cousins! I'm not sure how many Cousins we have on this list but I think we have representation from the Elias David line, the Burrel of AL line, the Arthur of GA line and the Burlingham 3rd line. If we have any more lines represented, I sure would like to hear from you! Some of you are aware that I and a few others have been relooking at the traditional beliefs about the parentage of Elias David Rudd and others descended from Burlingham Rudd the 1st. I want to thank all of you that have provided me with copies of documents and helped examine the information and push along this process (Gloria, Jacque, William Harry, Ron, Anne). I think that finally getting everything in one place to look it together with some additional documents I've found will shed new light on what we THOUGHT was the make up of the family. I can't draw any real conclusions yet and we may never know the real TRUTH, but the picture is surely changing. We need to explore many more areas and look at many more relationships with related lines. I few weeks ago I said I would post the Marriage Settlement of Mary Whaley Rudd when I received it from the SC Archives. But now that I've gone through it, I think it has to be posted in relation to the Will and Estate Inventory of Burlingham and the Will of Mary Whaley. According to the Will of Burlingham he had a Marriage Contract that detailed the property settlement upon his death written about the same time of his Will in 1827. This must be about the time they married. The property settlement was processed in 1835 and his Will was Proved in 1836, his estate was appraised in 1836. This is most likely about the time he died. In 1848 Mary Whaley writes a Will revoking all others which implies she too had a Will drafted at the time of the marriage. This one was Proved in 1850. So that must be about the time she died. I'll post copies of all these documents for you to read. It makes a very interesting story! And one note, you will see a reference to "intermarriage" and this is being explored right now. Most all of us are familiar with the story of Burlingham that married Mary Whaley. But it's a lot more complicated than we thought. I hope we can find someone researching the descendants of the Rodella Whaley and Hartswell Green Rudd because through Hartswell Rudd we may find which Burlingham he really is. Rodella Whaley is the daughter of Ann C. Williams and William Whaley. William Whaley is the son of Mary Williams and George P. Whaley, Sr. This is the widow Mary Whaley who married Burlingham. And it looks like Mary Williams Whaley was perhaps the aunt of Ann C. Williams. After William Whaley, Ann C. Williams Whaley married Hiram C. Rudd. This second marriage is after the Burlingham and Mary Whaley union. So it might be the c.1885 Rodella and Hartswell marriage that created intermarriage for Burlingham and Mary Whaley. I have a death date of 1875 but do not know what town or county in which death occurred. Any hints on how to go about this?
