CAPPS Subject: Re: Thomas Haynes Hi Cousin Betty, I still have a question concerning which of the Rainwater females was the wife of John Fortenberry. This is where I base my claim for Jane Rainwater: Spartanburg Co Deeds, Vol V , pg. 616 Power of Attorney John Fortenberry X State of South Carolina To No 771 X Spartanburg District Andrew Mathias X Feb 10th 1836 X To wit, I do hereby assign, and release unto Andrew Mathias all my right, title and interest, of, in, or to a distributive share (say one sixth) of the Real and personal Estate of John Rainwaters, Deceased, to which I am entitled in right of my wife, formally Jane Rainwater, daughter of said Deceased, to be collected, used, and disposed of, by the said Andrew Mathias, according to his will and pleasure. Saving and reserving the amount for which Jonathan Low, (say fiftynine dollars & 68/100) which shall be first paid, or discounted by the Administrator and the balance be the sum more or less, paid to the said Andrew Mathias, and the said Administrator and the Ordinary of Spartanburg District are hereby required to make the settlement of my Interest in the Estate of John Rainwaters, Deceased, according to the above release. Given under my hand and seal, this 17th Sept. 1834. Sealed and delivered in presence of: Wm Trimmer X John # Fortenberry Thomas Haynes State of South Carolina X Spartanburg District X Personally came William Trimmer before me an made oath that he saw John Fortneberry, sign, seal and deliver the within Power of Attorney. And that Thomas Haynes, together with himself in the presence of each other witnessed the same. Sworn to before me, 10th Feb'y 1836. H. T. Dean, J. P. Wm Trimmer ---------------------------- To me, this is pretty convencing evidence for Jane. It is true that she could be Sarah (Sallie) Jane, and used the name Jane or was called Jane by her husband, John. I think it is also possible that there was another sister named Sarah (Sallie) Rainwater who was married to John Nebhur (or Nebughr). John Haynes
