In Jan term 1858, B.B.McKenzie, his administrator,petitioned the court to sell the land of his "intestate" (Hugh). The land was a tract of 250 acres in Richmond Co on the forks of Rocky Frok worth $1.50 to $2.00 per acre. The land descended to Hugh Rainwaters(sic) and the children of Mary Rainwaters, his heirs at law "who are not residents of this state." The court ordered that publication be made within the state requiring the defendants to appear at the Mar term of court of Pleas and Quarter Sessions on the third Monday in Apr to show cause why a sale may not be decreed. As the estate papers contain an account of the sale, apparently no heirs appeared to object to the sale.They probably never saw the advertisement in the papers and never even knew of their inheritance until after the sale. The information above came from Sandy Patterson (Mrs.Irvin V) of Lee's Summit, Missouri. I plan to check it out the next time I'm in Salt Lake, which will be the 15th Jan. I would like to find the final settlement papers for him. I have found the filing of the petition for probate for Hugh in Ark by his son Francis Marion . Hugh died "intestate" so an inventory had to be made of his holdings. (GS#1290718-Bk D pg 261). As I said, this is only the first paper filed, there are a lot more. I have about 30 family group sheets on the John Calvin Rainwater family in Wayne Co.,Ms. Plus on the 1870 census the 2 youngest boys are listed as "orphans" meaning their father was deceased but not necessarily the mother.(John Calvin and Benjamin Franklin "Frank" However, I cannot find Sidney on the 1870 census. Perhaps she md between 1866 and 1870. All the Creels seem to come from S.C.,Tn and Ala. One of John and Anna's children-William md Sabra Whittington whose daughter Lillian md Joseph Warren Sprinkle. One of their descendants is doing research on the Creel line. I'll close for now as it after 1 am. Let me know what you have already and I'll try to fill in as many gaps as I can. Ann, I don't believe any documentation has been found to date that identifies the parents of James the Preacher or James the Blacksmith. If you have a document or documents that tie James the Preacher to Ben and Sarah, I would appreciate it if you could point us in the right direction. Thanks. Hi Annie, Thanks for the compliment- I've only been doing research for about 45 years now and it was learned mostly by trial and error. There weren't any seminar's or classes taught by anyone except on local levels-so we've come a long way. Right now I'm working on my certification (CGRS). Long slow and sometimes tedious, but rewarding. Yes, I've sent Robert Albert several packet's of information. I also have all the issues printed of "Rainwater Researcher" He used to live in Ventura but he moved to Bakersfield, just about the time the newsletter stopped coming. Susan, I read that census not long ago and it was not Barbara on there. It was Balzora. Amelia and Permelia is a name that was used inter- changeably on the census and elsewhere a lot. Especially on the southern names. Milford was only married the one time. Did you record that all the family was born in Kentucky, with the exception of the last one? Also you have to remember all children up to Balzora were born before 1880. There is no 1890 census so we have to rely on the 1900 one. Balzora was the only child bn before 1880 who moved to Texas with them. All the rest were bn after 1880 and before 1900. I would say they made the move in 1893/94 as Julia is bn Oct 1895 in Williamson Co.,Tx.Would have to read probate records to find out for sure. Hi Janas, The obituary for Charlie J. Rainwater appeared in the Baldwin New Herald on 23 Jan 1947. It says he was born 4 Mar 1863 in Greene Co Ms.(The 1900 census says he was bn Jan 1872 and Julia Henrietta Still (Steele) was bn May 1875. The children- James-bn Apr 1896 and May bn Oct 1897. Also in the household is Esther Stills-bn June 1845. It states that they've been married 5 years: had 5 children but only 2 living. They married 6 Sep 1894. On the 1910 census Charles is age 35; Julia Henrietta is age 33. Joseph (James) is age 12;Mary (May) is age 10;Molly is age 8;Maggie is age 6. On the 1920 Charles is listed as James C. age 48;Julia H is listed as age 42; Eliza is age 21;Ida (Mary ?) is age 20; Lilly E.(Molly) is age 18; Myrtle is 13; and Nola is age 10. The obituary mentions that they had 8 children-7 daughters and 1 son. Julia; the son and 1 daughter died before him. He died 15 Jan 1947 and was buried 18 Jan in the Elberta Cem. Arrangements were in charge of Troyer Funeral Home. If you wrote to them, they would probably send you the obituaries on the other members of his family who had died.Can you send me your information so I can add it to this family record? He was married to Hester Ann Nicholson !!! not Nicholls. She was bn 3 Mar 1883 and died 19 Feb 1920, evidently during the big flu epidemic. They are both bur in Union Grove Cem Wayne Co.,Mo John Lysander was the son of Christopher C.and Jane (Hale) Rainwater. Christopher was age 5 on the 1860 census bn Wayne Co.,Mo. He was the 6th child and 3rd son of Francis Asbury and Sarah "Sallie" (Moore) Rainwater. I don't have a marriage date for Christopher and Jane,nor can I find more than the 1 son-John L.Surely there are more. He was bn just before the 1880 census-there is no 1890 census and by the 1900 John is in household of George W. listed as "nephew" Francis and Sallie had 10 known children and 1 that's questionable- the last or 11th one-named Obediah bn 1890(the next child up is bn 1869. Hi Paula, Mariah was married to Pinkney Lanford of Spartanburg,SC. He was a Baptist minister. He was the son of Lewis L Lanford and Mary Leatherwood. They moved to Fayette Co.,Ala just before their 4th child was bn. He was bn near Vernon,Fayette,Ala. Mariah died about 10 May 1859 when her last child was bn. She is probably buried near Vernon somewhere.I don't have anything on any of the others. I need to do some in depth research on these families when I get the chance. There were 2 sets of Rainwater's in Fayette/Sanford/Lamar Co Ala. One was my line (William and Elizabeth Lucas Rainwaters descendants) and the other was Miles and Nancy (Edwards) Rainwater's descendants which was Silas Mercer R. Do you know who she married? That would help me a lot. Silas and his wife were the only family having kids in Lamar in the 1880's (other than my line) I've proven most of mine and she's not on them. Let me know.
