In Jan term 1858, B.B.McKenzie, his administrator,petitioned the court to sell the land of his "intestate" (Hugh). The land was a tract of 250 acres in Richmond Co on the forks of Rocky Frok worth $1.50 to $2.00 per acre. The land descended to Hugh Rainwaters(sic) and the children of Mary Rainwaters, his heirs at law "who are not residents of this state." The court ordered that publication be made within the state requiring the defendants to appear at the Mar term of court of Pleas and Quarter Sessions on the third Monday in Apr to show cause why a sale may not be decreed. As the estate papers contain an account of the sale, apparently no heirs appeared to object to the sale.They probably never saw the advertisement in the papers and never even knew of their inheritance until after the sale. The information above came from Sandy Patterson (Mrs.Irvin V) of Lee's Summit, Missouri. I plan to check it out the next time I'm in Salt Lake, which will be the 15th Jan. I would like to find the final settlement papers for him. I have found the filing of the petition for probate for Hugh in Ark by his son Francis Marion . Hugh died "intestate" so an inventory had to be made of his holdings. (GS#1290718-Bk D pg 261). As I said, this is only the first paper filed, there are a lot more. When I was first considering transfering the old Rainwater Network mailing list to automated facilities, a few of the then subscribers indicated they were concerned the list would get cluttered with superfluous postings. This the main reason why this list is to be kept focused on the business of genealogy. I'm sure most of us have an opinion about the antics of our country's politicians, but these opinions should be kept private and off the main mailing list, as should the myriad of seasonal greetings keep private between individuals. I'm saying this only once here for the benefit of about 30 new subscribers that have recently been added. You Rainwater cousins who have been around for a while know all this, sorry to bore you by repeating it. As far as SPAM, RootsWeb's filtering software takes care of deleting those things before they reach the lists. However, if anyone would like to receive spam mail, just make one genealogy inquiry or posting to a message board at a large online service such as AOL. John Rainwater, husband of Mary Fussell, died in 1777 (will dated November 4, 1771, proved 1777). Thus he cannot be the father of Miles Rainwater, husband of Nancy Edwards, as he was born in 1787. Mary Fussell was born about 1710, so she cannot be his mother. There is a generation skip here. The James Rainwater who was Miles's father probably was the son of John Rainwater (wife Susanna) and grandson of John Rainwater (wife Mary Fussell). Because records are lacking, we cannot make these statements unequivocally. John and Mary (Fussell) Rainwater has children John, James, Mary, Sarah, Betty, Winney, Milley, Molly, and William, according to the will. The list of children you gave includes several attributed to their son John (e.g., Solomon), but others I cannot assign. Joseph B. Adding to what Jim Farmer wrote, I believe I found William Edwards in the 1830 census, although it of course could be someone else of the same name. He was certainly dead by 1835. His wife, Mildred (Smith) Edwards (Milly) died June 6, 1839, Spartamburg Co., SC, according to the same Bible source. Jim does establish that there was an Isaac Edwards in the earlier generation, but he died in 1808. If this Isaac is a brother of William, then that makes him another son of Edward Edwards. I too have looked for Edward, but did not find him yet. It is likely that he came from outside of SC, so there are a lot of places to look. At least Edward Edwards is not a common name. Nancy Edwards's other grandfather, William Smith, may be a hopeless cause. Joseph B. Dear Mrs. Carlton: Further on the question of the father of Nancy Edwards, wife of Miles Rainwater. Can you (or anybody) send me a copy of page 82 from the Spartan Baptist Asso. booklet? I have copies of pp. 70-71 and 91-93, but not 82. I thought I had all the mentions of Miles Rainwater. Page 70 mentions Miles briefly but mostly this section is about James the preacher. Page 92 describes the events surrounding Miles's death, which I have found nowhere else. This page is the source of the misinformation that Miles married Nancy Miles, who actually was his mother. Interestingly, another of this church histories (my ancient copy gives neither the title nor page, but it may be this same pamphlet) states that "Rev. James Rainwater, a near relative of Miles Rainwater, ... married Nancy Miles, daughter of Sarah Farrow and Thomas Miles." It seems that people liked to marry Nancy Miles off rather frequently. Estate records do indicate that she was married to a James Rainwater, but the ages fit better for James in the generation prior to that of Miles, James the blacksmith, and James the preacher. Looks like a lot of Rainwater descendants are interested in the Rev. Miles Rainwater, son of James Rainwater, line. Perhaps we could have an online family reunion in a private chat room sometime. You are correct about the two additional children of Miles and Nancy (Edwards) Rainwater. Miles died intestate, so his estate records were concerned with sorting out his heirs, in particular his minor children. Sarah had married Livingston/Levingston ("Leve") Bobo, son of Tillman and Bulah (Yarbrough) Bobo apparently before Miles Rainwater died. As a result she was not listed among the minor children. Sarah was born April 22, 1808, and died January 19, 1881. She and her husband are buried at the Wesley Chapel Methodist Church cemetery in Fayette Co., AL. Wiley Rainwater was born April 25, 1814, and died July 25, 1814. The parents of Miles Rainwater were James and Nancy (Miles) Rainwater. The wife of his son Miles Jr. was Sarah Edwards according to the Newells' History of Fayette County, but I cannot vouch for the validity. Joseph B. Situate in Ninety-six District on a small branch of Jimmies Creek of Tiger River bounded by lines running SE by Richard Youngs and Stephen Wilsons Land. N (by Jonathan Sinard(sic). NE Unknown, etc., etc. (I have a copy of the original land grant and of the Plat) Brent Holcomb records in his book "Spartanburg S. C. Minutes of Co. Court 1785-1799" that a Deed of Conveyance was made to John David Nebuhr from Edward Hooker & wife. It was acknowledged in open Court and ordered to record. In the 1800 census of SC indexed by Vern Jackson there is listed: Nebuhr, John D...Charleston Co. S.C. page 146 00010-00001-00. 1 male 26-45 and 1 female over 45. No children are listed. On July 29, 1807 it is recorded that Salley Nebur returned her citation but could not give security for Letters of admn. John Rainwater was then granted a citation on the Estate of John David Nebur decd to return on Monday 3rd of July (I believe it should have read August 1807. On August 3, 1807 Letters of admn. were granted to John Rainwater on the estate of John Nebur. On August 8, 1807 John Rainwater turned in an appraisement of part of the personal estate of John David Nebur decd which amounted to $2408 exclusive of debts. Nov. 3rd 1807 John Rainwater returned a schedule of the book accts and notes due the said decd estate. Feb. 13, 1810 John Rainwater as admr. of the estate of Jno D. Neabour made a return $1196.9.8. Jan. 1811 John Rainwater made a return and requested maintenance of John D. Nebhur Junior son of sd. decd. Jan. 6th 1812 and Mar 1813, John Rainwater again made returns on the estate of John Nebuhr decd. In Book T, p. 77 on Mar., 1825 John Rainwaters (Spartanburgh) for love and affection gave to his grandson, John D. Nebughr a sorrel mare about 6 years old. This was witnessed by John Brooks. Signed with John Rainwater' mark. Wit. oath May 23, 1825 John Brooks to W Hunt and recorded May 24, 1825. (Note: This could be for his grandson's 21st birthday) On Mar 3, 1828 John D. Nebughr of Spartanburg Dist sold for $100, 50 acres of land known by the name of Flint Hill, land originally owned by his father. It was bounded by John Hughe and Andrew Barry NE, Mallec Eskridge and Enoch Underwood W and SW, Miller NW. Witnessed by Saml Pearson and Matthias Rush. Signed by John D. Son: Simpson was born abt 1831 daughter, Sarah was born about 1836 Listed on the same page, next to him was William Bomar Senr. and in the same vicinity the names, Edward Bomar, Vincent Wyatt Between 1830 and 1840/41 the family moved to Benton Co., TN In the State Archives, Nashville, TN I found a printed record of County Court minutes of Benton Co., TN, Book 2, 1842-1851 as follows: (P-3) July Term 1842 Personally appeared in open court James K. Nance Guardian of John A.; James Simpson and Sarah Niber, Minor heirs of John D. Niber, Deceased and together with James Presson and Thomas Jones his securities and entered into acknowledged their bond in the sum of one thousand dollars conditioned as the law direccts for the faithful performance of said Guardian. Reel 59, Miscellaneous Records, Benton Co. TN - I have copied the microfilm and typed up the information on the Settlement of the Estate of John D. Neeber, dec'd. James K. Nance, as guardian of the children had to report every year to the court how the money was being spent, etc. An estate of $575.00 was devided up equally among the children. He had to report until each child reached the age of 21 or as in the case of Sarah, they married (her balance was turned over to her husband, Aug. 2, 1852). On May 9th 1854, James Nance made a final settlement on the remaining Neber-- Simpson. (Note: Various spellings of Nebughr/Neber/Neabor/Nabor/Neighbor/Niber/Neeber are used in documents I found. Nebughr and Neber have prevailed.) My thoughts: John D. Nebuhr Sr. to have died by July 22, 1807. John D. Nebuhr Jr. probably born 1804 if he turned 21 in 1825 and was probably only son of John D. Nebuhr Sr. and he is a grandson of JohnxSusannah Rainwater. Salley possibly married again, long before her father's death. Some think John Fortenberry and some Silmon.
