Queen administrator of McDowell Queen vs Tobias Queen, Letta Queen, Linda Queen heirs at law of McDowell Queen and Julius Queen and Franey Queen - The petition of P.K. Queen showeth: (1) that he is the only qualified administrator of the estate of McDowell Queen, who died intestate in Burke County in Jan. 1895; (2) That the said intestate left surviving him your petiioner and the defendants Tobias, Letta and Linda Queen as his next of kin and only heirs at law. Linda and others are residents of Burke County except Letta Queen who is in Cleveland and Tobias in Catawba County and all of full age; (3) that petitioner is informed and believes that the defendant Julius Queen is the owner by assignment of Letta and Linda Queen of all interests they and each of them may have in the estate of his intestate; (4) that Franey Queen is the mother of the intestate and is the owner of a life estate in the lands herein after described by devise from Solomon Queen the original owner, who devised the remainder over to the intestate of your petitioner; (5) that the estate of McDowell Queen is indebted in the following sums so far as your petitioner can ascertain the facts - to Joseph Mull; to Burial expenses; to T.M. Webb, Sheriff Taxes; to Riley Tallent; in all fifty dollars which together with the costs and charges of administration will absorb the estate; (6) there is not personal property remaining unsold and what has been sold amounted to but $3.55; (7) that subject to the life estate of Franey Queen above set out the intestate of your petitoner was the owner in fee of the following described land in Burke County a tract of 18 acres of land adjoining land of J.H. Cook, Mick York and others beginning at a white oak Queens old corner and runs S. 41 degrees East 128 poles to a black walnut in Pinkney Queen's line, there N. 41 degrees east 20 poles to a stake in J.H. Cooks line, then north 20 degrees west with J.H. Cook's line to a red oak and pine Cooks corner, then south 53 degrees west 60 poles to the beginning corner containing 18 acres more or less; (8) that a sale of said land is absolutely necessary in order to discharge the debts of the intestate and pay the costs and charges of administration and that the land is reasonably worth $50.00.
