If a cemetery ever ends up being surrounded by private property, the owner of the property has to provide and access road for people to get to the cemetery. He calls his boss back. He told me, after relating all that to his boss, the boss said, if I don't leave he should call the sheriff. While he is on the phone I managed to get photos of most of the headstones through the fence. I knew I was right and had the law on my side, but also had other things to do rather then have the sheriff read the cemetery law book, I carry with me, all day.I left and went on to other cemeteries. This problem happened once in the past which I did relate in an older Cemetery Report.     1. [Q-R] Cemetery Report: May 17, 2017 " The Vedder's are Coming"

    3. Out the door at 4:47AM at 60F. Arrived at Schenectady, N.Y. at 6:45AM @ 57F and stopped at Stewart's for coffee. 7:16AM brings me to an odd cemetery. Surrounded by a Shopping Mall. I think it bought out the Vedder farm estate property years ago and kept the cemetery intact and built around it. Has never been touched. They built a steel fence around it which is locked.I went looking around and found security for the mall and asked to be let into the cemetery. I followed him by car back to where the little cemetery is by the front door of K-Mart. We both stood there and he called his boss, the boss said he dint want security to unlock the gate for me, it was up to building maintenance to do it. How long do I have to wait? He said about 10AM. I told him I only needed to get in there for about 3 minutes and I'd be out of here. Sorry that's what my boss told me, even though he has the key. I asked him what would happen if I went over the fence, he would call the sheriff dept and have me arrested. Knowing the state law on cemeteries, I told him it was public domain and I demanded to be let in now. And told him I had the laws in the car if he wanted to read them. Then I'll have you arrested for trespassing. I told him I didn't think that would work at a Mall. As the public is always free to enter the property at a mall. Its a public place. Its private property he said. OK, according to cemetery laws, this is covered also. If a cemetery ever ends up being surrounded by private property, the owner of the property has to provide and access road for people to get to the cemetery. He calls his boss back. He told me, after relating all that to his boss, the boss said, if I don't leave he should call the sheriff. While he is on the phone I managed to get photos of most of the headstones through the fence. I knew I was right and had the law on my side, but also had other things to do rather then have the sheriff read the cemetery law book, I carry with me, all day.I left and went on to other cemeteries. This problem happened once in the past which I did relate in an older Cemetery Report. And I was allowed to enter, do my thing and leave with out being further bothered.
