Greetings All. I have just spoken to Dan O'Donnell, the investigator in the Office of the Information Commissioner regarding our complaints against the Chief Statistician of Canada. The last time I spoke to him he indicated his best guess on when the response to our complaints would be forthcoming was 4 June 2004. Unfortunately we will have to wait a little longer. Mr. O'Connell indicated things are in the final stages and while he was unable to advise what that meant he now hopes that the reponses to our complaints will be available by mid to late June. He has promised to keep me apprised of any changes that might occur in this. While further delay is disappointing, so long as the end result is what we hope and expect we can afford to be patient for a little longer. On my recent trip to Calgary I had the opportunity to meet with Lois Sparling. Our legal action for the 1911 National Census is still on track. Our hearing in Federal Court is still scheduled for 8 June 2004 in Calgary. The only thing that will prevent the proceedings from going ahead would be if the government suddenly released the 1911 records. That is what happened when the 1906 records were released on 24 January 2003. I am not, however, holding my breath on that happening again. I do not expect a decision of the Court to be brought down on the day of the hearing. I suspect the Judge will reserve decision to have time to consider the arguments, pro and con, from each side. If the decision is based solely on the legislation we feel certain that we will win. Things being what they are, however, nothing is certain and we will have to wait and see what happens. Should we win we can probably expect the government to appeal the decision. If we lose, we will most certainly be appealing ourselves. Happy Hunting. Gordon A.
