No mention is made of the parents of either party to this marriage, or of Jean Deniau (1673-1708), late husband of Thérèse Ménard. The record indicates that Ysambart, Curé at Longueuil from 1720 to 17631, celebrated this marriage at Boucherville at the express order of the Bishop of Québec, and that the act of marriage was registered at Longueuil as well as at Boucherville. Another notation is included in the record: This couple has been married for several years "à la gomine", while M. de Francheville, missionary at Longueuil, was celebrating the Holy Sacrifice. Although the date of the earlier "marriage" is not specified in the acts, it presumably took place after the death of Jean Deniau on 3 November 1708, and before the birth of Pierre Desnoyers, eldest child of Jean Desnoyers and Thérèse Ménard, on 28 August 1710. Before their marriage was "rehabilitated" in 1724, the couple had become parents of seven children. The marriage of Jean Desnoyers and Thérèse Ménard illustrates an interesting aspect of the evolution of church law regarding marriage. In 1563, the Decree Tametsi of the Council of Trent instituted a substantial and compulsory juridical form for the celebration of marriage, specifying that marriage be celebrated "coram sacerdote ? necnon coram duobus testibus" [before a priest ? as well as before two witnesses].3 A practice eventually developed that couples who intended to enter marriage would sit in the back of the church while Mass was being celebrated, and exchange consent witnessed by two of their family members or friends. Canonical lore would have it that the practice was first devised by a Québecois named Gomin, which is why it is known as "mariage à la gomine". Later church law would specify more clearly the precise meaning of "coram" in this context. "Coram ecclesiae" usually translated in French as «en face de l'Église» does not mean "on the church steps", or "while the priest is celebrating Mass", but "with a priest as a qualified witness to the exchange of consent between the parties". Moreover, in order to minimize the possibility of "mariages à la gomine", particular ecclesiastical law in the Diocese of Québec early in the 18th century, and elsewhere, specified that the exchange of consent should be noted in a register kept in the church or parish house, and that the priest and witnesses able to do so should sign that register. It is for this reason that the marriage of Jean Desnoyers and Thérèse Ménard was "rehabilitated" in 1724 by the specific orders of the Bishop of Québec. One final question is raised by this "rehabilitation": Was the "mariage à la gomine" of Jean Desnoyers dit Desmarais and Thérèse Ménard dit Lafontaine a valid union, or not? Since there was no official interpretation that "coram sacerdos" (en présence du prêtre) excluded sitting in the back of the church while Mass was being celebrated, the answer to this question is Affirmative. Nonetheless, a properly witnessed exchange of consent was performed in 1724; significantly, the names of both Defrancheville, missionary at Longueuil when the "mariage à la gomine" took place, and Ysambart. One took place before the Vatican issued decrees specifying that "in the presence of a priest and two witnesses" meant that both the priest and the witnesses needed to sign a register recording the marriage. Another took place in New York at a time where the Vatican decrees had never been published, at a time when there was not a single Catholic priest in the State of New York. Fr.
