The noble and learned lords present this morning were the Lord Chancellor, Lord Chelmsford, Lord Westbury, and Lord Colonsay. THE SECRETARY OF STATE IN COUNCIL V. UNDERWOOD. The hearing of the arguments in this part-heard appeal from the decision of Vice-Chancellor Wood (the present Lord Chancellor) was resumed this morning. Sir Roundell Palmer, Q.C., Mr. Forsty, Q.C., and Mr. Macnaghten appeared for the appellant; Mr. Anderson, Q.C., Mr. Huddleston, Q.C., and Mr. Steele for the respondent. The respondent, Mr. William Elphinstone Underwood, was a member of the Civil Service of the East India Company on the Madras establishment, and was a subscriber to the Madras Civil Service Annuity Fund. On the 1st of May, 1860, he resigned the service and accepted an annuity of 1,000 l. per annum in accordance with the regulations of the fund, since when he has been in receipt of his annuity. The quest in this appeal was whether, in addition to the annuity, the respondent was entitled to a re-fund of the excess of the accumulated value of his contribution to the fund over and above the half value of the annuity, as fixed by the rules of the fund. At the conclusion of the arguments, Their LORDSHIPS reserved judgment.
