    2. Yes there is a list of burials, but it was done in the '30's. I don't know if anyone has done it recently. If you need it copied you can get a copy from the York County Historic Trust, 250 E. Currently, I have a good biography of Alexander Ewing's son Rev. James Wesley Ewing(born 1786) who married 3 times and had 15 children. 11 of the children were with his second wife Justina Grove. The full biography is attached to my tree, see the following link: http://trees.ancestry.com/pt/person.aspx?tid=7116564&pid=-1160917836 I also have information on a John Ewing who married Lydia Godfrey. Lydia Godfrey's sister Sarah Godfrey married Justina Grove's brother John Grove, Jr. Thus I am guessing that John Ewing and Rev. James Wesley Ewing may be siblings. John Ewing and wife Lydia are listed in the 1850 census in Fawn, York County, Pennsylvania as age 49, but I have found Lydia's birth record in Saddler's Church for Dec 1795 and suspect John Ewing is about the same age. Any information linking John Ewing and Rev. James Wesley Ewing together as siblings would be greatly appreciated. Important Note: The author of this message may not be subscribed to this list. The act also stipulates that ownership of previously deemed abandoned grounds may be regained (or similar right may be awarded) if owners present themselves within 30 years after the interment rights have been deemed abandoned. This act also states that burial ground caretaker organizations or landowners are not obligated to keep a burial ground "safe for entry or use by others or to give any warning of a dangerous condition, use, structure, or activity on the premises of a historical burial place." However, the act also notes that burial ground caretaker organizations or landowners may be found libelous "for willful or malicious failure to guard or warn against a dangerous condition, use, structure, or activity on the premises of a historic burial place." Note: See below for definition of Historic burial place. _Historic Burial Places Preservation Act of April 29, 1994 (P.L. 141, No. 22)_ (http://www.phmc.state.pa.us/bhp/protection/HISTORIC%20BURIAL%20PLACES%20PRESERVATION%20ACT.pdf) This Act defines "Historic burial place" as "A tract of land that has been in existance as a burial ground for more than 100 years wherein there have been not burials for at least 50 years and wherein there will be no future burials or listed in or eligible for the National Register of Historic Places as determined by the Pennsylvania Historical and Museum Commission." It further states that municipalities may not use eminent domain to take a historic burial ground for an alternate use. PHMC approval must be given before a burial ground is taken for "public use." If the burial ground is taken for public use, then the burial ground authority must preserve a record of what was removed. This record must be sent to the county and PHMC. Furthermore, this Act also stipulates that the following actions are illegal: the removals of a fence, tomb, monument, gravestone, or fragment. These actions are legal only if the object(s) is being removed with consent of the owner or descendent and a court order for the purpose of "repair or replacement, reproduction or preservation and display in an accredited museum." Since YOU HAVE TO HAVE APPROVAL by the court to exhume a grave, there should be a listing of this in the local courthouse. Like I said, my county has a book of names of the dead, where they were originally buried, dates of birth and death, and where they were transferred to. You may wish to call the courthouse of the county you believe the burial took place and see if they don't have documentation of the event. Blessings, Janet

However, I have never been able to locate his tombstone at either the church or Prospect Hill Cemetery. If anyone knows the location of his tombstone, please let me know. Thanks. Harold A. Weigle hweigle1@cox.net In 1956 The Federal Government paid someone to go around all the counties of PA and list the tombstones found there. Some of these records remain in private hands, some ended up in the local library. For York County they were given to the County Library who, when they needed the space more, donated the work to the local Historical Society. They will not publish the info, someone a few years ago told me they made over 200,000. in one year from writeins and they need the money to keep the HS going. They charge $50. dollars per request plus .20 cents per page (this info might be outdated). They might have the info on Johann Martin Weigel that you are looking for. Renee L. Waring Renee L. There is a Christ Lutheran in downtown York, but there is also a Christ Lutheran Church in Spry, at the corner of Queen Street extended (PA74) and Church Street. Dave Ludwig Researching Ludwig, Falkenstine, Shearer, Kreidler in Pennsylvania, and Pauley and Butler in Illinois FYI Dave. I noticed the name Shearer above. Did you know that it is also written as Jury and Shirer? I have a Jury family in upstate PA and the name was broken up and can be found as Jury, Shirer, Shearer, and Shira etc. in the Church records. Definitely German. Renee L. Waring **************AOL Search: Your one stop for directions, recipes and all other Holiday needs. Search Now.
